초록

1886년 조선에서는 전국적으로 콜레라가 유행하였다. 이때는 아직 조선정부에서 공식적으로 검역규칙을 정비하여 시행에 들어간 시점은 아니었다. 따라서 조선 내에 설치된 세 곳의 개항장마다 콜레라 예방을 위한 방역활동이 각각 다르게 나타났다. 원산에서는 조청일 3국 관리가 콜레라에 대처할 수 있는 방향을 협의하였고, 공조가 원활하게 이루어져 방역활동이 잘 이루어졌다. 이와 달리 부산에서는 지역 내에서 검역규칙의 시행을 두고 각 주체 간에 마찰과 갈등이 발생하였다. 부산영사가 먼저 검역규칙을 제정하여 시행하겠다고 하자 조선 감리를 비롯하여 각국 관리들이 사전 동의를 구하지 않았다면서 크게 반발한 것이다. 여기에 항내 무역상황에 따른 경제적 이해관계도 영향을 미치고 있었다. 인천에서는 현지에서 대처해야 할 긴급성과 조약 적용상의 법리 문제를 두고 본국과 현지 영사 간에 입장차가 존재했다. 영사에게는 검역규칙을 제정할 권한이 주어지지 않았기 때문에 현지에서 이미 발포한 규칙을 본국에서 사후 취소하는 선에서 사태를 수습하였다. 조선의 각 개항장에서 근무 중이던 일본 영사는 방역활동을 전개할 수 있는 규칙을 구체적으로 제시하기는 했다. 여기서 향후 검역시행의 표준을 선점하고자 하는 의도를 읽을 수 있다. 하지만 검역규칙의 시행은 조선 감리와 해관장, 각국 외교관들로부터 동의를 받아야 하는 문제였다. 더 나아가 조약 운영상 문제가 없는지 본국으로부터 검토와 승인을 받는 과정도 거쳐야 했다. 검역규칙의 제정과 시행에는 각국 여러 주체들의 이해관계와 자국민 보호란 문제가 복잡하게 얽혀 있었다. 시의성이 있고 시행 취지가 좋다고 하더라도 개항장에서 일본영사가 제안한 그대로 검역규칙을 관철할 수는 없었다. 1886년 조선의 각 개항장에서 경험한 방역 경험과 정보 축적은 이듬해 조선정부가 검역가규칙을 제정하고, 각국의 동의를 얻어서 시행하는 방향으로 나아갈 수 있는 밑거름이 되었다.

영어초록

In 1886, cholera was prevalent nationwide in Joseon. This year was not yet the time when the Joseon government officially overhauled quarantine rules to go into effect. Thus, quarantine efforts to prevent cholera varied depending on each of the three opening ports in the Joseon Dynasty. In Wonsan, officials of the three countries(Joseon, Japan and Qing) discussed ways to deal with cholera, and quarantine activities were carried out smoothly. On the other hand, Busan underwent friction and conflict between the parties over the implementation of quarantine rules within the region. When the Japanese consulate said that it would establish quarantine rules first and implement them, officials from various countries, including the Joseon Dynasty, strongly protested against the movement, saying that they did not reach prior consent. On top of that, economic interests were also affecting circumstances of port trade. In Incheon, there were differences between the home country and the local consulate over the urgent issue to be dealt with locally and the legal principles of applying the treaty. Since consular officials were not authorized to establish quarantine rules, the situation was settled into cancellation of the rules already issued there. The Japanese consul working at each port in the Joseon Dynasty suggested specific rules to develop quarantine activities. At this point, we can read Japan's intention to preempt the standard of future quarantine inspections. The enforcement of quarantine rules, however, was a matter that required consent from the Joseon official Gamri, the maritime Acting Commissioner and diplomats from each country. Furthermore, they had to go through the process of obtaining review and approval from their home countries if there were any problems in the operation of the treaty. The establishment and implementation of quarantine rules were complicated by interests of various players in each country concerning protection of their own citizens. Even though it was timely and the purpose of implementation was good, it could not follow through the quarantine rules as proposed by the Japanese consul at the opening port. The accumulation of quarantine experience and information at each port of Joseon in 1886 provided the foundation for the Joseon government to move toward to establish quarantine rules and implement them with the consent of each country in the following year.
