사회권의 재판규범성 ― 자유권･사회권 이분론을 넘어 ― (Justiciability of Social Rights — Beyond the Dichotomy Between Liberal Rights and Social Rights —)

초록

사회권은 헌법과 한국 정부가 비준한 국제인권법상에 명문화된 기본적인 권리이다. 하지만 사회권은 국가 행위의 정당성을 심사하고 권리구제를 동반하는 재판규범으로 잘 적용되지 못하고 있는 것이 우리의 현실이다. ‘사회권은 자유권과 달리 그 규범적 내용이 모호하고, 국가의 적극적 행위와 재정을 요구하기에 재판규범으로서는 적합하지 않다’는 인식이 아직도 학설과 재판실무에서 뿌리 깊게 자리 잡혀 있는 데 상당 부분 그 원인이 있다. 현대 인권 보장의 시대는 모든 기본권의 실효성 있는 보장을 위해 국가의 적극적 행위와 재정의 투입을 요구한다는 점에서 자유권과 사회권에 대한 도식적 이분론은 넘어설 필요가 있다. 사회권에 대한 헌법심사는 대의제를 통해 잘 대표되지 못하는 가난하고 취약한 사람들의 현실에 관심을 쏟게 하고, 헌법이 요구하는 사회권 보장 의무를 이행하기 위한 국가행위의 정당성에 대한 숙의를 촉진하는 방식으로 기능할 수 있다. 이를 위해, 사회권 실현을 위해 구체적인 정책을 형성할 정부의 재량을 존중하면서도, 사회권을 보장해야 할 국가의 헌법적 의무에 대한 설명책임과 투명성을 높이는 방향으로 사회권에 대한 헌법심사가 실질화되어야 할 것이다. 또한, 인간 존엄에 합당한 사회권의 최저선과 관련해서는 이를 설정하는 절차와 방법에 대한 심사기준을 발전시켜 나가야 할 것이다. 사회권 실현을 위한 입법 및 행정 조치의 합리성(reasonableness)에 대해 설명하도록 하는 심사 모델, 인간의 존엄에 합당한 사회권의 최저선을 보장하기 위한 의무 이행 여부를 따지는 ‘최소핵심의무’ 기준은 그러한 점에서 중요한 검토의 대상이 되어야 한다.

영어초록

Social rights constitute the fundamental rights explicitly recognized in the Constitution and the international human rights treaties that the Korean government has ratified. Nevertheless, social rights have not been adequately applied as legal norms in the court by which the justifiability of the state actions are reviewed and effective remedies are provided in the case of a violation. It is largely because the perception that social rights, unlike liberal rights, are vague in their normative content and necessitate positive state action and substantial resource allocation, and thus are not suitable for justiciability remains prevalent in judicial practice as well as scholarly work. However, it is necessary to go beyond such dichotomy between liberal rights and social rights in that contemporary human rights protection requires positive state action and resource allocation for the effective guarantee of all fundamental rights. Constitutional review of social rights can serve the function of directing attention to the reality faced by people living in poverty and in vulnerable situation who are not adequately represented in the representative political system, as well as facilitating deliberations about the justifiability of the state action meant for the realization of social rights. In this sense, judicial review of social rights must be made to further enhance the accountability and transparency of the way in which the state relinquish its constitutional obligations concerning the situations of people living in poverty, while respecting the range of discretion of forming concrete policies for the realization of social rights. Furthermore, it is necessary to develop the standards that can be used to review particularly the minimum level of social rights in consistent with human dignity and the procedure and methods to determine it. Examining the ‘reasonableness’ standards and the concept of ‘minimum core obligations’ should be part of the process of exploring the way to enhance the constitutional review of social rights.
