형치, 법치, 그리고 덕치 : 조선의 좋은 정치[善政] (The Governances by Punishment, Law and Virtue: 'Good Politics' in Joseon Dynasty)

초록

이 연구는 크게 두 부분으로 구성되어 있다. 하나는 유교의 법치(法治), 덕치(德治) 관념의 오래된 오해를 풀기 위해 형치(刑治) 개념을 추가하여 해명하는 것이고, 다른 하나는 그 실제 사례를 조선(朝鮮)의 세종(世宗)의 치세를 통해 논증하는 것이다. 어떤 정치공동체든 그것이 정치공동체로 존재하기 위해서는 법치(法治)의 성격을 벗어날 수 없다. 법으로 대표되는 물리적 강제력은 정치적 공간에서만 유일하게 합법적으로 존재할 수 있기 때문이다. 유교사회는 법치의 두 기제 가운데 ‘동의’ 부분을 ‘덕치’로, ‘강제’ 부분을 ‘형치’로 개념화 하였고, 강제에 기반한 형치가 최소화되고, 동의에 기반한 덕치가 최대화하는 공동체야말로 ‘좋은 정치, 곧 선정(善政, Good Politics)’라고 인식했다. 조선의 세종(世宗) 또한 당연히 형치적 법치(강제)와 덕치적 법치(동의) 모두를 사용하였다. 다만, 세종은 형치를 최소화 시키고 덕치를 최대화하는 덕주법보(德主法輔)를 실천하였다는 점에서 유교적 최고 군주였다. 세종은 형치의 경우 부득이할 때 행하였고, 그나마 경형주의(輕刑主義)에 입각하였다. 또 신하들의 반대에도 불구하고 지방관의 탐호와 비리를 백성들이 직접 고발할 수 있도록 하는 법령을 제정하고 주인의 횡포로부터 노비의 인권을 보호할 수 있는 법령 등을 제정하였다. 이는 세종이 법의 본래 기능을 약자를 비롯한 공동체 구성원 모두의 보호라는 법정신에서 찾고 있음을 보여주는 것이다. 이러한 세종의 덕주법보 실천은 양민(養民)과 교민(敎民)에 기반한 덕치공동체의 구현 노력이었고, 오늘날과 같은 형치식 법률 만연 풍토를 극복하는 귀감이다.

영어초록

This study consists of roughly two sections: one to correct the misconception of Confucianism, Governance by Law and Governance by Virtue by adding the concept of Governance by Punishment; and the other to look into their examples from the governance under King Sejong in Joseon Dynasty. No political community can exist as it is without the character of Governance by Law because the physical enforcement represented by law can exist legally only in a political space. This is not different in a Confucian community too. Unlike such persistent and stubborn prejudice of the western scholars, Confucian communities have conceptualized, from two forms of Governance by Law, the 'Agreement' into 'Governance by Virtue' and 'Enforcement' into 'Governance by Punishment' under the cognition that 'Good Politics' are only on the community that maximizes the agreement based Governance by Virtue while minimizing the enforcement based Governance by Punishment. Joseon Dynasty worked also in the same way as she put Confucianism as her national political idea. King Sejong positively used both (enforcement based) Governance by Law in the style of Governance by Punishment and (agreement based) Governance by Law in the style of Governance by Virtue. As he was the best king of Joseon Dynasty, a Confucian country, however, King Sejong performed the idea of DeokJuBeopBo(德主法輔: Governance mainly by virtue with supplementation by law) that maximized Governance by Virtue while minimizing Governance by Punishment. He did not want to perform Governance by Punishment in most cases except for inevitable cases. Even in such inevitable cases, he stood on the Idea for Minimal Punishment. He enacted the acts for the poor and minor group including the acts for the people to accuse their local governors of greed and corruption directly to the central government, the acts to protect the human rights of the slaves from tyranny of their owners and etc, trying to look for the reason of existence of Governance by Punishment only from the original spirit of law that should protect the poor and minor group. Such performance of DeokJuBeopBo by King Sejong was his efforts to realize a community of Governance by Virtue based on the idea to feed and enlighten the people, and it is a valuable model that alerts today's climate prevailed by law, which is like Governance by Punishment.
