한일대륙붕협정의 외교사적 고찰과 미해결 과제: 동아시아 해양 거버넌스의 구축을 향하여 (A Diplomatic Review and Unresolved Task of Korea-Japan Continental Shelf Agreement: towards the Establishment of East Asian Ocean Governance)

초록

본 연구는 한일대륙붕협정의 협상 과정을 외교사적으로 추적하여 동아시아의 해양질서가어떻게 정립되어 왔는지를 조명하고자 한다. 논의는 현대적 의미의 동아시아 해양 거버넌스의형성에 밀접한 연관성을 지닌 한일대륙붕협정에 어떻게 영향을 미쳤는지를 고찰하고 동시에미해결 과제의 한일대륙붕협정에 대한 해법 모색에 초점을 맞추고 있다. 주목할 것은 한일대륙붕협정이 관할권 주장과 관련된 분쟁 해결 차원이 아니라 관리의 차원에서 불확실성의 해소, 행위자의 조정, 글로벌 책무의 이행 등과 같은 개념을 통해 동아시아 해양 거버넌스의 구축을지향하고 있다는 점이다. 전후 한일해양질서의 재편과정에서 한일대륙붕협정은 트루먼 선언과UN해양법협약의 전이, 평화선 철폐와 한일어업협정의 체결, UN의 극동경제위원회 보고서와해저광물자원법 및 동법 시행의 제정 등과 같은 외교사적 사건과 연동되어 동아시아 해양 거버넌스의 하나의 축으로 자리매김하고 있다. 비록 동아시아의 해양은 자원민족주의에 의해다양한 마찰요인들이 존재하였지만, 한일 양국은 경제와 안보라는 두 개의 이익을 공동으로확보한다는 관점에서 대륙붕공동개발협정을 체결했다. 한일 양국은 국제사법재판소의 권고에따라 공동 관할 이용 혹은 개발에 관한 합의, 공동개발안의 공식화, 한일공동위원회의 설치등과 같은 특징을 협상 과정에서 수용했다. 그럼에도 불구하고 한일대륙붕협정은 비효율적인공동개발 관리구조, 형식적인 분쟁 해결 및 제도, UN해양법협약의 변화에 따른 일본의 소극적인 이행거부 등과 같은 문제에 직면하고 있기 때문에 2018년 12월 현재까지도 실질적인 성과를 거두지 못하고 있다.

영어초록

This study aims to illuminate how East Asian ocean order has been established by tracking the negotiation process of Korea-Japan continental shelf agreement.
The discussion focus on tracking how Korea-Japan continental shelf agreement, which is closely related the formation of East Asian ocean governance in the modern sense, affected. It is notable that Korea-Japan continental shelf agreement aims to establish East Asian ocean governance which is not about conflict resolution with jurisdictional claims but, in the administrative level, through concepts such as the solution of uncertainty, the actor’s adjustment, the implementation of global responsibilities. In the process of reorganizing the Korea-Japan ocean order after the war, Korea-Japan continental shelf agreement settle down as an axis of East Asian ocean governance in conjunction with diplomatic and historical events such as transforming Truman Declaration and UN ocean law convention, the abolition of the peace line and the conclusion of Korea-Japan fisheries agreement, the report by the Far East Economic Council of UN, enactment of the undersea mineral resources law and the enforcement of same law. Although the oceans of East Asia had various frictional factors due to resource nationalism, Korea and Japan signed a joint continental shelf development agreement from the perspective of securing the two interests of economy and security. Also, the two countries, at the recommendation of international court of justice, accepted features such as the use of a joint jurisdiction or agreement on the development, the formation of joint development plan, the establishment of Korea-Japan joint commission in the course of negotiation. Nonetheless, Korea-Japan continental shelf agreement has not made any real progress to the present day of December, 2018 because the agreement is facing problems like inefficient joint development management structure, formal dispute resolution and system, Japan’s passive refusal to implement due to changes in UN convention on the law of the sea.
