한국 매장문화재 발굴조사의 현황과 과제 - 2022년 매장문화재법령의 개정과 한성백제 도성지역 개발사업의 현안을 중심으로 - (Issues of Excavation and Investigation of Buried Cultural Properties in Korea : Focusing on the Revision of the Buried Cultural Heritage Act in 2022 and the Current Issues of the Hanseong Baekje Capit)

초록

2022년 매장문화재법에‘국가 등에 의한 지표조사’관련 조항이 신설됨에 따라, 그동안 건설공사의 시행자만이 매장문화재 조사기관을 통해 지표조사를 할 수 있었던 문제점을 보완하고, 매장문화재를 보호하고 관리하기 위해 국가와 지방자치단체가 학술적인 목적으로 지표조사를 실시할 수 있는 법적 근거가 마련되었다. 그리고 함께 신설된‘중요 출토자료의 연구 및 보관 등’관련 조항을 통해서는 문화재의 여부를 떠나, 발굴조사로 출토된 인골과 미라의 연구 및 보관을 법률로써 뒷받침할 수 있게 되었다.
한편, 수도권의 대규모 재건축・재개발사업과 관련하여 한성백제 도성 지역의 매장문화재 발굴조사가 언론의 주목을 받았다. 잠실 진주아파트 재건축 부지 내 유적에서는 풍납토성에서 조사된 수혈식 주거지들보다 규모가 큰 23m 길이의 육각형 주거지가 확인되었다. 전체 사업 부지의 2.3%에 해당하는 유구 밀집 지역의 보존방안이 문화재위원회에서 심의되었는데, 아파트 단지 내 공원부지로 이전하여 보존될 예정이다. 이 발굴조사로 재건축 사업이 중단된 것처럼 보도되기도 하였으나, 발굴조사와 보존방안의 심의가 사업계획에 차질이 주지 않았다는 것이 사업시행자의 공식적인 입장이다.
그리고 백제 한성기의 주거지와 수혈 등이 밀집되어 확인된 서울 풍납2동 복합청사 신축부지 내 유적의 보존방안 심의 결과에 대해서는 지방자치단체인 송파구가 문화재청을 상대로 행정처분 취소소송을 청구하였다. 그러나 송파구의 이런 조치는 문화재 보호 및 관리제도의 개선을 촉구하는 학술단체들의 성명서 발표에 빌미가 되기도 하였다.

영어초록

In 2022, as the provision related to ‘surface investigation by the state, etc.’ was newly established in the Buried Cultural Heritage Act, the problem that only the implementer of construction work was able to conduct surface investigation through a buried cultural heritage investigation agency has been supplemented. Accordingly, in order to protect and manage buried cultural heritage, a legal basis was established for the state and local governments to conduct surface surveys for academic purposes. In addition, the newly established provision related to ‘research and storage of important excavated materials’ made it possible to legally support the research and storage of human bones and mummies excavated, regardless of whether they are cultural heritage or not.
On the other hand, the excavation investigation of the Hanseong Baekje capital area in connection with the large - scale reconstruction and redevelopment project in the metropolitan area received media attention. In the reconstruction site of Jinju Apartment in Jamsil, there was a dwelling with a length of 23m, which was larger than the dwellings investigated at Pungnaptoseong. In the new construction site of the Pungnap 2-dong complex government building, 93 dwellings and pits of the Hanseong period of Baekje were investigated.
At one time, it was reported in the media that the reconstruction project was suspended due to excavation and investigation of the reconstruction site of Jinju Apartment in Jamsil. However, the official position of the project operator is that the excavation did not interfere with the project. In addition, Songpa-gu, a local government, requested the cancellation of an administrative disposition regarding the result of the deliberation on the preservation plan in relation to the the new construction site of the Pungnap 2-dong Complex Government Complex. This has been an important cause for academic societies to issue statements urging improvements in the cultural heritage protection and management system.
