중앙정부와 지방자치단체 간 협력강화 방안에 관한 연구 (A Study on Improving Cooperation Between Central and Local Governments)

초록

본 논문에서는 중앙정부와 지방자치단체간 협력의 필요성과 중요성 그리고 관련 이론적 배경을 검토하고, 지금까지의 현황과 문제점을 중앙정부의 지방자치단체에 대한 기능배분과 지도감독, 중앙과 지방간 협력체제를 중심으로 그 실태와 문제점을 진단하는 한편, 현 정부에서 준비하고 있는 전략과 과제 및 계획들을 살펴보고 이를 토대로 협력을 위한 발전과제를 제시하고자 한다. 민선 7기가 출범한 현시점에서 우리가 당면한 피할 수 없는 시대적 요청은 지방분권을 통한 지방자치 기반을 더욱 공고히 하는 것이다. 앞으로 자치분권을 지속적으로 추진하고, 국가와 지역경쟁력을 강화하여 국가 재도약의 기반을 마련하기 위해서는 중앙의 권력을 과감하게 그리고 획기적으로 지방에 이전시켜서 중앙과 지방정부간의 관계를 새롭게 정립하는 것이다. 오늘날의 자치분권의 개념은 종전과 같이 독재권력이 지배했던 중앙정부에 대한 단순한 저항을 의미하는 소위 항의적 투쟁적 개념은 퇴색하고 대신에 국민복지향상을 위하여 중앙과 지방이 서로 경쟁하고 협력하는 협력적 분권으로 그 의미가 전환되고 있다. 이에 따라 중앙정부와 지방자치단체와의 관계도 기본적으로 지배, 복종의 관계보다는 기능분담과 공동생산의 관계로, 그리고 저항과 거부의 관계보다는 ‘경쟁과 협력’의 관계로 방향전환이 이루어져야 한다. 1987년 민주화와 지방자치 부활 이후에도 우리의 국정운영의 기본틀은 중앙집권 그것도 청와대 중심에서 크게 변하지 않아 왔다. 그동안 청와대가 중심이 되어 추진해 온 경제혁신, 국민안전, 공공개혁들 심지어 자치분권까지 모두 중앙정부의 위상과 기능만을 더욱 공고히 하고 말았다. 모든 권력이 중앙정부 그것도 청와대로 집중될수록 그 결과는 국정실패와 국가위기로 나타나기도 한 바 있다. 따라서, 현 정부가 성공하기 위해서는 국정의제를 시행하기에 앞서서 국정운영의 틀과 방식을 과감하게 바꿔야 한다. 국정운영의 틀은 청와대와 중앙정부 중심의 중앙집권적 통제체제에서 수평적, 수직적 분권을 통해 삼권분립의 중앙정부와 함께 지방정부 중심의 지방분권형 협력체제로 바꿔야 한다. 그리고 그 운영방식은 투명과 공개, 소통과 협치 중심이 되어야 할 것이다. 요컨대, 지방자치 부활 28주년을 지내면서 현 정부가 의욕적으로 자치분권종합계획을 제시한 지금부터는 협력의 지방자치 시대를 열어가야 한다.

영어초록

This paper reviews the necessity, importance and related theoretical background of cooperation between central and local governments, and the current problems are diagnosed in terms of the central government's function allocation and supervision of local governments, and the central and inter-regional cooperation systems. As part of this review, the strategies, tasks and plans being prepared by the current government are examined, and the developmental tasks for enhanced governmental cooperation based on them are presented. The inevitable call in these current times, when the seventh term of the civil elections was launched, is to further consolidate the local autonomy base through decentralization. In order to continue to push for self-government and to lay the foundation for national re-engagement by strengthening national and regional competitiveness, the central power should be boldly and radically transferred to the provinces to establish a new relationship between the central government and local governments. Today's concept of self-rule, which implies simple resistance to a dictatorship-controlled central government, is shifting its meaning to cooperative decentralization where the central and provincial governments compete and cooperate to achieve better welfare for the people. Accordingly, the relationship between the central and local governments should be changed from a relationship of control and submission to a relationship of division of functions and joint production, and further, to a relationship of competition and cooperation rather than resistance and rejection. Even after democratization and the revival of local autonomy in 1987, the basic framework of our state management has not changed much from a central government at the center of Cheong Wa Dae (The Blue House). Economic innovation, public safety, public reform and even autonomy, which the presidential office has been pushing forward, have all only consolidated and strengthened the status and functions of the central government. The more that power is concentrated in the central government and Cheong Wa Dae, then the more failure of results will be seen in state affairs and during national crisis. Thus, for the incumbent administration to succeed, it must drastically change the framework and the way it manages state affairs before implementing any and all agendas. The framework for managing state affairs should be changed from a centralized control system that is focused on the presidential office and the central government to a more regional decentralized cooperation system centered on regional governments, along with the central government's separation of the three powers (legislative, executive and judicial) through horizontal and vertical decentralization. Furthermore, its operation should be centered on transparency, disclosure, communication and cooperation. In short, the current administration should open an era of cooperative autonomy starting right now and in line with its proposal for a comprehensive plan for autonomy ahead of the 28th anniversary of the revival of local autonomy.
