고등교육기관간의 차별완화를 위한 법제검토 (A Study on the Legislation to Mitigate the Discrimination among Higher Education Institutions)

초록

고등교육기관간의 차별을 완화하기 위해서는 관련 법제화가 이루어져야 하고, 이러한 법제화를 위해서는, 복지로서의 교육권에 대한 이해가 선행되어야 한다. 특히 고등교육기관간 차별의 결과로서 나타난 대학 서열의 고착화 문제를 해결하기 위해서는, 첫째, 지방대학에 대하여 재정지원을 확대할 수 있는 특별법이 마련되어야 하고, 둘째, 국가의 국립대학에 대한 재정지원 특혜를 없애야 하며, 셋째, 직업중심 대학에 대한 차별적 법제를 개정해야 한다. 물론, 대학서열 고착화의 문제는 대학 자체의 문제만이 아니라 사회의 전반적 시스템과 연관된 문제이기도 하다. 그리고, 정책과 법이 사회적 약자나 차별받는 자의 편에 서야 한다는 입장에서 본다면, ‘적극적 평등실현조치’와 관련된 법제화 작업이 과감히 진행되어야 할 것이다.

영어초록

To mitigate the discrimination among higher education institutions, the related legislation should be made. For the legislation, at first the understanding of the education rights as welfare should be preceded. To solve the difficult problem of the eternal freeze on the university ranking, the differentiation of higher education institutions according to the location, the establishment subject and the function is to be mitigated. In particular, private higher vocational institutions in local have most suffered from lots of segregation.
The efforts to legislate the law to destroy the fixed order of the university ranking is as follows :
First, a special law to expand the financial support of the government for local higher education institutions should be set up to lessen the discrimination among higher education institutions by the location. Second, the preferential treatment of the government for national universities in the funds is to be exterminated to reduce the discrimination. Third, the unfair laws for higher vocational education institutions should be revised to relieve the discrimination and to raise the social recognition on technicians
The problem of the fixed university ranking stemmed from the discrimination caused by the location, the establishment, the function is not only the universities' own issue, but also a matter closely related with the overall system of the society. The policy and the law must stand by the socially differentiated weak positively. Therefore, even if it is to be a little bit difficult to enforce it at the start, the work to legislate the law related with the Affirmative Action, should be affirmatively progressed.
