초록

우리나라는 2018년 노인인구가 전체인구의 14%이상인 고령사회에 진입했다. 세계에서 가장 빠른 고령화 속도를 보이는 우리나라는 2025년경 전체인구의 20%가 노인인구인 초고령화 사회에 진입할 전망이다. 이에 따라 질병과 신체질환 및 치매 등을 겪고 있는 노령인구의 수는 급증하고 있다. 게다가 핵가족화 및 여성의 노동시장 진입등으로 이와 같은 노인들을 부양하기가 구조적으로 어렵게 되어 있다. 이에 정부는 2008년 노인장기요양보험법을 제정 및 실행해 이를 대비하고자 했다. 이 법이 시행된지 13년이 지난 현재 운영부분에서 여러 문제가 노정되고 있다. 재원조달 방식, 부당청구의 문제, 장기요양급여의 질적문제, 돌봄체계 내에서의 장기요양보험법의 위치문제 등이다. 장기요양보험법 및 제도의 지속적 운영을 위해서는 이 문제들을 개선할 필요가 있다. 특히 초고령사회를 목전에 둔 지금 시점에 이 문제에 대한 과제를 고민할 필요성이 있다고 사료된다. 따라서 본 연구는 노인장기요양보험법의 의의, 구조 및 제도의 현황을 살펴보고 상술한 문제와 과제에 대해 논했다. 본 연구는 현 노인장 기요양보험법의 법과 제도적 개선방안을 고찰하면서 돌봄체계 하에서의 장기요양보험법의 재정립에 대해서도 고찰해 보았다는 것에 함의가 있다고 사료된다.

영어초록

Korea entered an aging society where the elderly population is 14% or more of the total population in 2018. Korea, which has the fastest aging rate in the world, is expected to enter an ultra-aging society, where 20% of the total population is the elderly population by 2025. Accordingly, the number of elderly people suffering from diseases, physical diseases, and dementia is increasing rapidly. In addition, it is structurally difficult to support such elderly people due to the nuclear familyization and the entry of women into the labor market. In this situation, the government tried to prepare for this by enacting and implementing the Long-Term Care Insurance Act for the Elderly in 2008. As of 13 years after the Long-Term Care for the Elderly Act was enforced several problems are emerging in the operational sector. These include the method of financing, the problem of unfair claims, the quality of long-term care benefits, and the position of the Long-Term Care Insurance Act within the elderly care system. These problems need to be improved for the long-term care insurance law and system to continue to operate. In particular, it is believed that there is a need to consider the task of this issue at the moment when the super-aged society is at hand. Therefore, this study examines the significance, structure, and system of the Long-Term Care Insurance Act for the Elderly, and discusses the above-described problems and tasks. This study is meaningful in that while examining the laws and institutional improvement measures of the current Long-Term Care Insurance Act, it also considered the re-establishment of the Long-Term Care Insurance Act under the care system.
