초록

홍콩은 1997년 7월 1일 중국의 홍콩귀속직후, 아시아 금융위기(IMF)등의 영향으로 주식과 부동산 등 다방면에서 하강세를 보였고, 실업률 역시 기록적 수치를 갱신하고 있었다. 2001년 12월 11일 중국이 WTO에 가입하자, 홍콩이 누려온 중개무역지로서의 우월적 지위의 상실을 우려한 홍콩 재개는 동젠화(董建華) 행정장관을 통하여 중국 중앙정부에 자유무역협정(FTA: Free Trade Agreement)와 유사한 협정을 체결할 것을 건의하였다.
WTO가입추진에 주력하였던 나머지, FTA에는 소극적이었던 중국은 홍콩과의 FTA체결을 위한 협상 개시를 전환점으로 하여 경제자유화전략과 동아시아지역 리더로의 부상전략을 본격적으로 추진하면서 FTA등 지역협력추진에 주력하기 시작하였다.

The purpose of this research is to identify the legal aspects of the context, the legal basis, the independence, and the subject of discipline of the China-Hong Kong Closer Economic Partnership Arrangement (CEPA) and to anticipate its future prospect. CEPA, a special form of FTA agreed by a country and its local separate customs territory, is composed of a main article that constitutes the expediency of trade investment, freeing of service trade, removal of non-tariff barriers, and the tariff on trading goods as well as 6 subsidiary articles. The legal basis of the CEPA are the international law and the domestic law, namely the exceptions of the regional economic integration under the agreement of WTO and the article that guarantees Hong Kong a capital lease under the constitution of China and the fundamental law of Hong Kong. The independence of the CEPA carries a duplicate status of being a continental customs territory and a separate customs territory of Hong Kong while standing as an official member of WTO and the CEPA's subject of discipline similarly fulfills a duplicate status of being associated in both an economic trade relationship among domestic customs territory and among WTO members. Although diverse opinions on municipal law, international law, and eclecticism are being suggested due to the duplicity of such legal basis, independence, and subject of discipline, the CEPA considers the legal attributes of the international treaty that concurs the views of both China and Hong Kong, both in legally equal positions, as the priority more than the characteristics of the municipal law. Furthermore, the CEPA is expected to develop into a regional economic integrated systematic mechanism, which is a form of FTA that has never occurred under the jurisdiction of the WTO, that forms a Great China Economic Community among China, Hong Kong, Macao, and Taiwan as well as the notion of "one country, two systems," which is the theoretical base of the unification of China.
