I. 서 론
우리가 살고 있는 사회는 더욱 더 복잡해지고 불확실성이 높아져 가고 있다. 과학기술의
발달로 인해 사회의 변화속도는 더욱 빨라지고 있다. 또한 최근에는 신공공관리 맥락에서
국가 혹은 정부의 역할과 범위에 대한 논의가 활발하게 진행되고 있다. 정부의 정당성에 관
한 문제는 정부에 대한 신뢰 부족과 불성실하고 이기적인 관료들의 부패와 같은 행태에서
더 크게 부각되고 있다. 1980년대 이후 미국 및 서구 각국에서는 정부 혹은 행정의 정당성
문제가 행정국가에서 더욱더 주목을 받고 있다. 또한 많은 행정학자들이 행정의 정당성에
논의의 중요성에 대해 언급하고 있다(김동원, 2003; 신희영, 2008; 이성로, 2000; Rohr,
1986; Terry, 1993a,b; Stillman, 1990; Stivers, 1993; Wamsley and Wolf, 1996). 행정
국가의 개념은 최근 거버넌스 개념과 정부의 역할 논의에서 떼놓을 수 없는 불가분의 관계
에 있다. 서구에서 나타나는 복지국가와 동아시아에서 나타나는 발전국가는 행정국가의 또
다른 표현으로 이해할 수 있다(정용덕, 2001; 양재진, 2005). Morstein Marx 와 Waldo가
의미하는 행정국가는 입법부와 사법부가 배제된 국가를 의미하는 것이 아니라 상대적으로
행정부의 권한과 기능이 강조되는 것을 의미한다.
사실, 정당성은 합법성 그 이상의 의미를 지니고 있다. 합법성은 법의 논리와 기능에서
전개되지만, 정당성은 법의 논리와 기능을 초월해 민주주의 이념과 국민들의 판단으로부터
