Ⅰ. 문제 제기 및 연구목적
청소년 비행의 종류가 다양화되고 있고, 그 빈도 및 강도 또한 나날이 증가하고 있다. 특히 우리 나라 청소년 비행은 비슷한 문화권인 중국, 일본 등과 비교해서 그 정도가 훨씬 심각한 것으로 보고되고 있다(일본 청소년 문제 연구소). (일본 청소년 문제 연구소, 1998)
이에 대한 예방적 사회 대책의 일환으로 청소년 보호법이 발효되어 실시되고 있으나 청소년 비행은 수그러들지 않고 있다.
이러한 청소년의 비행 문제의 해결을 위해서는 한편으로는 엄격한 법 적용을 통한 외부적 통제가 확고히 실시되어야 하는 동시에 다른 한 편으로는 그들이 근본적으로 비행에 빠져들지 않도록 하는 내부적 예방 조치가 실시되어야 할 것이다. 내부적 예방 조치 없이 외부적 통제만을 가하려 할 경우, 인력 및 예산의 엄청난 투입에도 불구하고 청소년 비행은 좀처럼 줄어들지 않을 것이다. 내부적 예방 조치에는 애초에 비행이 발생하지 않도록 하기 위해서 취해지는 근본적 예방 조치와 비행 발생 후 비행의 재발을 방지하고 건전한 생활로의 복귀를 위해 취해지는 치료적 개입으로 나누어 볼 수 있다.
청소년 비행을 감소시키기 위한 가장 효과적이고 경제적인 방법은 비행에 대한 예방이다. 청소년 비행의 예방을 위해서는 최초 예방이나 재발 예방 및 재활의 모든 경우 첫째, 청소년 비행에 영향을 주는 여러 요인들 중 어떤 요인에 개입해야 할 것인가를 알아내는 일이 시급하다. 둘째, 비행이 우려되는 요소들에 노출되어 있는 청소년들을 신속히 구별해 내야 한다. 셋째, 비행이 우려되는 청소년들에 대한 예방 서비스 및 치료적 개입이 시의 적절하게 제공되어야 한다.
본 연구에서는 청소년 비행에 영향을 주는 요인들을 다체계적 관점에서 종합적으로 조망해 본 후 각 체계별 요인들에 어떻게 개입해야 청소년 비행 문제의 예방 및 치료적 개입이 효과적일 것인가를 검토해 보았다. 이를 위해 기존의 청소년 비행 관련 연구들을 검토하여 청소년 비행에 영향을 주었다고 보고된 요인들을 확인해 냈다.
청소년과 관련된 기존의 법률들 청소년의 정의와 관련하여, 청소년 보호법과 아동복지법에서는 18세 미만의 자, 소년법과 민법에서는 20세 미만의 자, 청소년 기본법에서는 24세 미만의 자로 정의되고 있다. 소년법에서는 비행 청소년을 “소년”이라 이르는데, 이는 품행 등의 문제로 인하여 비행을 하였거나 반사회성이 있다고 판단되는 12세 이상 20세 미만의 자를 말한다. 이들을 소년법에 의거하여 구체적으로 서술하면 다음과 같다.
