우리 법제에서 이른바 OTT는 「전기통신사업법상」의 "온라인 동영상 서비스"로서 "정보통신망을 통하여 「영화 및 비디오물의 진흥에 관한 법률」 제2조 제12호에 따른 비디오물 등 동영상 콘텐츠를 제공하는 부가통신역무"로 정의된다. 하지만 이 새로운 미디어 형식에 대한 과학적이고 체계적인 개념, 그것이 도출되기까지의 여정을 보여 주는 기원, 복잡하게 분화하는 미디어 환경에서의 적용 가능성 등은 여전히 불투명하다. 이 글은 OTT에 대한 제도적 이해를 위한 지평으로 ‘인터넷 모델’을 제안한다. 인터넷 모델은 상호 접속과 차별 금지를 원칙으로 하는 인터넷 정신에 입각해 인류가 개발해 온 여러 종류의 콘텐츠를 서비스하는 전자 미디어 서비스 체계를 일컫는다. 따라서 인터넷 모델에서 미디어는 범용 인터넷에서 커뮤니케이션 서비스를 제공하는 일체의 플랫폼 정보 서비스(information service)이다. 이는 신문 모델, 방송 모델, 통신 모델, 영화(관) 모델 등에서 보여 준 물리적 네트워크와 미디어, 콘텐츠 형식의 결합이 인터넷 환경에서 디커플링되면서 만들어 낸 새로운 미디어 경로이다. 인터넷 모델은 기존의 미디어 역무 붕괴를 넘어 해체의 결과로 등장한 플랫폼 정보 서비스에 대해 설명한다. 역사적으로 인터넷 모델은 독과점의 지상파 시대인 TV 1.0, 다채널 시대의 TV 2.0 및 디지털 저장 장치를 매개체로 한 TV 3.0의 시대를 넘어, 스트리밍과 클라우드에 기반하는 플랫폼-미디어 시대인 TV 4.0을 기반으로 한다. TV 4.0은 이전의 시공간적 동기성, 서비스 범위, 운용 논리 등 모든 면에서 이전의 채널과 다른 플랫폼으로 캐즘화되어 있다 이 글은 인터넷 모델에 입각한 플랫폼 정보 서비스의 규제 프레임으로의 인식 전환을 촉구한다.

영어초록

The Telecommunications Business Act defines the so-called OTT, or "online video service" as a value-added telecommunications service that provides video content such as Video Products under Article 2, No. 12 of 「the Promotion of Motion Pictures and Video Products Act」. However, the proper concept and origin and applicability to a new type of media environment are not clearly reflected yet. This article proposes ‘Internet models’ as a horizon for institutional understanding of OTT. The Internet model refers to an electronic media service system that provides various types of content based on the Internet spirit, interconnection and non-discrimination. The institutional name of platform-media, commonly referred to as OTT, is 'platform information service'. This is a new media path created by the Internet environment that the combination of the physical network, media and content form, shown in newspaper models, broadcast models, telecommunication models, and movie models, has decoupled in. The Internet model describes platform information services that have emerged as a result of dismantling beyond the existing media service collapse. Beyond the era of TV 1.0, the era of monopoly terrestrial networks, TV 2.0, which opened the multi-channel era through cable TV, and TV 3.0, which started using digital storage as a medium, TV 4.0 era, that is the streaming and cloud-based platform-media can be subsumed as an Internet model. Various values and problems in nowadays media environment are derived according to the nature of the Internet model. Therefore, the institutionalization of the Internet model should be designed to cover these problems. Considering that the media landscape and related technologies are also variable rather than fixed, and the characteristics of the audience are also complex, a system that can flexibly respond to various issues should be sought. Through cooperative self-regulation based on the autonomy of the Internet, it will be possible to efficiently control issues arising in the market while ensuring freedom of expression and freedom of creation as much as possible within the media environment.
