아동인권의 이슈에 관한 트랜드 분석 (Trend analysis on the issue of children's rights)

초록

아동인권에 대한 이슈는 사회 환경에서 시대정신으로 표현되는 트렌드로 나타난다. 아동의 인권 이슈에 대해서 트렌드 분석, 이벤트 분석, 저널 분석을 실시하여 아동인권 보호차원의 문제점을 고찰하여 아동의 인권을 존중하는 방향 다음과 같은 몇 가지 요인에 의하여 결정된다는 것을 발견할 수 있다. 첫째, 아동이 자신과 관련된 의사결정 과정에 적극적으로 참여하여 목소리를 낼 수 있도록 제반 여건을 조성할 필요가 있다. 둘째, 유엔아동권리협약이 국가수준에서 비준되지만, 실제 실행은 각 지방정부 수준에서이루어지는 경우가 대부분인 점을 감안하여 이에 대한 필요한 지원과 모니터링이 요구된다. 셋째, 아동의 권리실현 및 인권침해와 관련한 고충처리기제가 법적으로 확보되어야 하며 효과적으로 작동해야 한다. 넷째, 아동･청소년분야에 종사하는 관련 전문직에 대한 인권교육이 강화되어야 한다. 우리사회의 교사, 상담가, 의사, 사회복지사, 청소년지도사, 관련 법률가 등 아동･청소년의 권리 실현을 위한 의무이행자로서의 관련 전문직에 대한 인권교육이 매우 필요하며, 특히 아동과 관련한 다양한전문직의 대학교과과정이나 커리큘럼에의 인권교육의 포함을 고려할 수 있다. 다섯째, 특히 취약집단 아동(가족과 분리된 아동, 망명요청아동, 원주민 아동 등)이 차별받지 않도록 매우 강조되었다. 우리사회 역시 다문화가정을 포함하여 북한이탈 가정, 그리고 난민 등 무국적 가정의 아동청소년들에 대한 관심이 더욱 필요하다. 이들에 대한 인권보호와 인권증진을 위한 내용이 법제화될 필요가 있다

영어초록

Issues in the human rights of children show a trend of being expressed as the spirit of the times in social environments. Trend analysis, event analysis, and journal analysis were conducted for issues in the human rights of children to examine problems in terms of protection of the human rights of children and through the analyses, it could be found out that the direction of respecting the human rights of children is determined by the following several factors. First, various conditions should be formed so that children can actively participate in decision making processes related to them and give their voices. Second, considering the fact that although the United Nations Convention on the Rights of the Child is ratified at the national level, it is actually implemented at the level of local governments in most cases, related support and monitoring are required. Third, mechanisms for the realization of children’s rights and treatment of grievance related to the invasion of children’s human rights should be legally secured and should effectively operate. Fourth, education on human rights should be reinforced for related professionals engaged in the area of children and youths. Teachers, counselors, doctors, social workers, youth field specialist, and related jurists in our society are those that should perform obligations for the realization of the rights of children and youths and education on human rights for them are much necessary. In particular, inclusion of education on human rights for diverse children related professionals in university curriculums may of considered. Fifth, efforts to ensure that children in vulnerable classes (children separated from their families, children that requested asylum, native children, etc.) are not discriminated were emphasized very much. In our society too, more attention should be paid to children in multi-cultural families, North Korean refugee families, and stateless families such as refugees. Measures to protect and promote their human rights should be legislated
