탐정학과 개설에 관한 논의 (Discussing the Establishment of the Detective Department)

초록

우리사회는 끊임없이 발생하는 범죄에 대응하고자 다양한 범죄예방 정책을 제시하고 있다. 다양한 범죄예방 정책에도 불구하고 국민들은 범죄피해를 당할 수 있다는 두려움으로 인해 경찰 등 국가기관에 의존하기 보다는 민간영역의 치안서비스를 활용하고자 한다.
민간영역의 치안서비스는 대표적으로 민간경비 및 탐정제도를 제시할 수 있다. 민간경비 분야는 시설경비업무, 신변보호업무, 호송경비업무, 기계경비업무, 특수경비업무 등 다양한 업무를 수행하면서 꾸준한 성장을 하고 있다.
반면 탐정제도는 1999년부터 도입을 하고자 하였으나, 탐정제도 도입에 있어서 찬성하는 입장과 반대하는 입장의 대립으로 난항을 겪고 있는 실정이다. 탐정제도에 반대하는 입장은 탐정은 조사가 주 업무로서 신뢰성과 전문성을 갖춘 우수한 인재를 확보하는 것이 용이하지 않다는 것이다. 그리고 각종 사건의 조사로 인해 개인의 인권침해에 대한 가능성이 있다는 것이다. 또한 경찰 등 공적인 국가기관과의 조사과정에서 상호 충돌할 가능성이 높다는 것이다. 탐정제도에 찬성하는 입장은 심부름 센터 및 불법 흥신소 등에 대한 폐해 근절 및 관리감독에 대한 근거를 마련할 수 있다. 다양한 범죄 발생으로 인해 치안과 관련된 업무를 효율적으로 부담할 수 있으며, 분쟁해결 과정에서의 증거수집능력을 보강할 수 있다. 뿐만 아니라 일자리 창출 및 경쟁력의 제고가 가능하다.
문재인 대통령은 대선 후보시절 ‘민생치안 역량을 높이기 위해 사실조사를 지원하는 공인탐정 제도 도입을 검토하겠다’라고 공약으로 제시하였다. 그리고 경제활력대책회의(2018년 12월 26일)에서는 ‘신서비스 분야 중심의 신직업 활성화 방안’을 논의하면서 정보 수집·관리 분야의 공인탐정을 신(新)직업군으로 제시한 바 있다. 또한 2018년 경찰청 규제개혁 추진 과제에서도 공인탐정제도 도입 근거 마련을 제시하였다.
이렇듯 우리나라에서는 탐정제도 도입에 대한 다양한 논의가 진행되고 있다. 이 중에서도 가장 중요한 핵심은 탐정은 적법한 절차에 따라 임무를 수행하여야 하며, 특정한 사안에 대하여 자료를 수집 및 조사하여 의뢰인에게 정보를 제공함으로 탐정의 전문성과 윤리성이 꼭 필요한 역량이다. 그러므로 탐정의 체계적인 교육을 수행할 수 있는 고등교육기관인 대학의 학과 개설에 대하여 탐정학과의 교육과정 및 목표 등에 대하여 살펴보도록 하겠다. 이러한 연구 수행은 향후 탐정학과 개설에 대한 기초적인 토대가 될 것으로 판단된다.

영어초록

Our society has proposed many crime prevention policies to respond to constantly occurring crimes. Despite the various crime prevention policies, the public wants to utilize the security services in the private sector rather than relying on state agencies such as the police for fear of being victimized by crime.
Public security services in the private sector can be representative of private security and detective systems. The private security field is steadily growing while carrying out various tasks such as facility security, personal protection, convoy security, machinery security, and special security.
On the other hand, the detective system was intended to be introduced from 1999, but in the introduction of the detective system, it is in a difficult situation due to a confrontation between the pros and cons. The position against the detective system is that it is not easy for investigators to secure excellent human resources with reliability and expertise as the main task of investigating. Also, it is highly likely that they will collide with each other in the investigation process with public state agencies such as the police. The position in favor of the detective system can provide a basis for eradicating the damages and supervising management of errand centers and illegal showrooms. Due to various crimes, it is possible to efficiently carry out security-related tasks and reinforce the ability to collect evidence during the dispute resolution process. In addition, it is possible to create jobs and enhance competitiveness.
President Moon Jae-in made a pledge to the presidential candidate during the presidential election, “I will consider introducing an official detective system that supports fact-finding in order to increase public security capabilities.” Also, at the Economic Vitality Meeting (December 26, 2018), while discussing the' new service sector-focused way to activate new jobs', the official detective in the field of information collection and management was presented as a new job group. In addition, the 2018 National Police Agency's regulation reform promotion project suggested the preparation of the basis for the introduction of the official detective system.
As such, various discussions on the introduction of the detective system are in progress. The most important of these is the ability of detectives to perform their duties in accordance with legitimate procedures, and by collecting and researching data on specific issues and providing information to clients, the expertise and ethics of detectives are essential. Therefore, we will look into the curriculum and objectives of the detective department for the establishment of the department of the university, which is a higher education institution capable of systematic education of detective. It is judged that the conduct of such research will be the basic foundation for the establishment of detectives in the future.
