스토킹 범죄 피해 실태와 피해자 보호 및 지원방안 - 스토킹 피해 조사를 중심으로 - (The Current States of Stalking Crime Damage and Measures to Protect and Support its Victims - Centering on the Investigation of the Damages to Stalking Victims -)

초록

2021년 10월 「스토킹 범죄의 처벌 등에 관한 법률」이 시행된 이후 여전히 스토킹 범죄가 사회 문제로 대두되고 있음에도, 스토킹 피해실태와 지원방안에 관한 연구는 부족한 실정이다. 이에 본 연구에서는 시민들을 대상으로 한 ‘스토킹 범죄 피해 경험’ 에 대한 분석을 통해 기존에 다루지 못했던 스토킹 범죄 피해자를 지원할 수 있는 방안과 예방 전략 그리고 스토킹 범죄 피해 이후 개입전략을 모색하고자 하였다. 이를 위해 2022년 「디지털 성범죄 및 온·오프라인 스토킹 범죄 피해 경험 조사」의 원시 자료를 이용하였고, 본 연구에서는 오프라인 스토킹 경험이 있다고 응답한 425명을 최종분석에 사용하였다. 자료 분석은 SPSS Win 25.0을 사용하였으며 응답자의 스토킹 피해 경험, 피해 이후의 대처방법 및 고통, 피해 경험 당시 필요했던 도움 등에 대한 응답을 통해 스토킹 피해가 가지는 복합성과 지원 요구도를 파악하였다.
연구결과, 스토킹 피해 경험이 있다고 응답한 425명 중 12개의 피해 문항에 대하여 1명당 3개 이상의 중복된 피해 경험이 있는 것으로 나타났다. 스토킹 가해자는 주로 연인 또는 배우자 등 친밀한 관계에서 발생하였으며, 피해자의 대부분이 일회성이 아닌 1주일 이상 지속되는 피해를 경험하고 있었다. 스토킹 피해를 경험하였을 때 피해자의 대부분은 가해자에게 직접 사과를 요구하거나 가족, 지인에게 도움을 요청하는 등 개인적인 대응을 하는 경우가 높게 나타났다. 스토킹 피해로 인한 정신적 고통은 불안 및 우울, 적대감이나 분노 등이 많이 나타났으며 이는 수면의 어려움, 위장 및 섭식 장애 등의 신체화된 트라우마로도 표현되었다. 또한 스토킹 피해는 일상생활에도 부정적인 영향을 미쳤는데 새로운 사람을 만나는 것에 대한 두려움, 혼자 다니기 무섭다는 응답이 높게 나타났다.
이를 통해 본 연구에서는 스토킹 피해자의 신고부터 피해자 지원까지 원스톱으로 이어지는 원스톱지원 체계 구축을 제언하였다. 스토킹 피해자 통합지원센터 설치를 통해 경찰 신고 이후 안전조치가 이뤄진 피해자를 대상으로 상담, 심리치료, 법률지원, 사례관리까지 이뤄지는 통합적인 지원을 통해 스토킹 재 피해를 방지하고자 하였다. 또한, 스토킹 피해는 초기대응이 중요한 만큼 스토킹 피해자의 위험 정도에 따라 피해자별 안전대책 수립을 통해 보호시설 입소, 이주비 지원, 민간경호 서비스 연계를 제시하였다. 마지막으로 스토킹 피해의 특성을 고려한 사례관리 시스템 도입과 트라우마 심리치료 지원을 통해 피해자가 일상을 회복할 수 있도록 제언하였다.

영어초록

Since the Act on the Punishment of Stalking Crimes has been promulgated in October, 2021, the stalking crimes have been considered as a social problem, but the research on the current states of stalking crimes and the measures to protect and support its victims has not been conducted adequately. In this context, this study aimed to seek the measures to support and prevent the victims of stalking crimes, which have not been supported, and the intervention strategies for the victims by analyzing the experiences of victims who suffered from stalking crimes.
For this study, from the Survey on the Experiences of the damages resulted from the Digital Sexual Crimes and On-and Off-line Stalking Crimes in 2022, the data of 425 respondents with the experiences who suffered from off-line stalking were utilized. The data were analyzed through SPSS Win 25.0. The complexity in the experiences of victims who suffered from being stalked and their needs were explored based on the responses to the questions such as the experiences of damages caused by being stalked, the ways to deal with the damages and the distress and the necessary helps when they were being stalked.
In the results of this study, all the 425 respondents who has experiences to be stalked answered that they have experienced 3 kinds of damages among all the 12 damages that were shown on the questionnaire. Stalking was likely to happen in the intimate relationships including spouses or persons who are romantically involved with and most of victims reported that stalking they had experienced lasted one week or over, not just one time. Victims were likely to deal with the stalking in the personal level including demanding an apology to the stalker in person or asking family members or friends for help. The mental distress of victims caused by stalking was led to anxiety, depression, hostility and angers resulting in difficulty in sleeping, gastrointestinal disturbance, and eating disorders, which may be the somatic symptoms due to the trauma. Furthermore, the stalking gave the negative effects on the victims’ daily life such as the fears to meet new people and walk around alone.
Based on the results of this study, it was suggested that the one-stop service system from reporting the stalking to supporting victims should be established. Furthermore, it was also suggested to install the comprehensive support center for stalking victims providing a one-stop service including psychological therapy, legal support and case management. Given the importance of initial responses to stalking, it was indicated that the services should be associated with admission to the shelter, aid of moving expense, and introduction of private security service. Finally the services to help victims regain their daily life such as the case management system and the support for the psychological therapy to treat the victims’ trauma have been also suggested.
