초록

2016년 10월 29일 첫 촛불집회로 시작되어 전임 대통령을 탄핵, 파면하는 성과를 거쳐 2017년 5월 9일 대한민국 제19대 대통령 선출로 그 시작의 매듭을 지은 ‘촛불시민혁명’은 1987년 6월 항쟁 이래 국가 차원에서 한 세대의 민주주의 운영에도 불구하고 민주주의의 질적 측면에서 대단히 퇴행적인 정권들의 연속적 집권으로 각종 적폐가 가득 쌓인 대한민국의 국가 개조라는 과제에 직면하고 있다. 이과제의 해결에 있어서 가장 중요한 문제는, 대한민국의 국가 시민이라면 누구나 동의할 수 있는 국가 개조의 적절한 지향목표를 정립하고, 그러한 목표를 달성하는 추동력을 어디에서 창출하느냐 하는 점이다.
이 문제에 있어서 본 논문은 이제 막 그 시작이 끝난 ‘촛불시민혁명’이 (대한제국에서 일제강점기를 거쳐 민족분단을 겪으면서 현재의 대한민국을 성립시킨) 현대한국의 국가정치 경험을 압축적으로 정식화시키고 있는 현행 <대한민국헌법>의 국가목표와 헌법질서와 한 치의 어긋남도 없이 진행되었다는 점에 주목한다. 현대 주권국가로서 대한민국 성립의 계기가 되는 안중근 의사의 항일의거의 내면에 대한사고실험과 ‘촛불시민혁명’ 진행과정에 대한 현장분석을 통해 필자는 이번 사건에서 비로소 건국운동 이래 거의 백년을 꿈꿔온 ‘대한민국’의 꿈, 그 헌법공동체의 이념 즉 “주권자 시민과 일체가 된 민주공화국”이 체현되었음을 적시한다. 촛불시민들은 <대한민국헌법>의 헌법질서에 적시된 기준과 절차에 따라 국정농단의 적폐세력을 축출하였으며 그동안 침식되었던 민주공화국 주권자의 권리를 요구하였다. 이런 점에서 촛불시민혁명은 그 어떤 이념이나 이데올로기가 아니라 실정적 효력을발휘한 헌법질서 안에서 ‘주권자 시민정치’와 ‘국가 통치기구’의 투트랙-공(共)작동으로 추진된 것이다. 그리고 이 주권자 시민정치의 과정 안에 진보와 보수, 좌와 우,그리고 각 지역으로 분열되어 있던 국민들이 다양한 요구를 갖고 결집하였다. 결국촛불시민혁명 2기를 이루는 국가개조 과정에서 대한민국의 각종 시민을 국가 시민으로 묶는 규범적 통합이념은 헌법이 될 수밖에 없으며, 이 헌법을 중심으로 한 헌법공동체의 주권자들이 대한민국 민주개혁의 추동세력이 될 수밖에 없을 것이며,헌법의 각 조항들이 개혁지표로 작동될 것이다.

Finishing its beginning with the election of the 19th president ofDaeHanMinKook (Republic of Corea) through the great political achievement ofimpeaching and firing the prior president Geun-Hye Park since the firstcandlelight rally in Oct. 29th, 2016, the Candlelight Civic Revolution in SouthCorea confronts at now with a task of the state-remodelling of DaeHanMinKook inwhich each kind of deep-rooted evils has accumulated fully during the nine-yearold successive seizure of power by two extreme-right conservative governmentswhich were of regressive character with respect to the quality of democracy inspite of one-generation long process of democratization since June DemocracyMovement of 1987. The most important point of the task is, whether anappropriate end of the state-remodelling which any citizen of DaeHanMinKook isable to universally accept can be set up, and whether a driving force to achievesuch end can be firmly created among the Corean citizenry anywhere in theCorean society and state.
On this problem-situation my article takes attention to the mode of the actualprocess of the Candlelight Civic Revolution which has never deviated any oneinch from both the state-purpose and the constitutional order prescribed in thecurrent Constitution of Republic of Corea which formulates compactly thehistorical experiences of national politics in modern Corea. Through the thinkingexperiment on the inner aspect of the anti-japanese righteous deed AhnJung-geun as the moment of establishing of DaeHanMinKook as an independentsovereign state and the field analysis of the process of the Candlelight Civic Revolution I point out that firstly just in this historical event a democraticrepublic unified with the sovereign citizenry, i.e. the ideal of the constitutionalcommunity, namely, the one-hundred years enduring dream of DaeHanMinKooksince the early trial of nation-building, has realized itself. The candlelight-citizensexpelled the forces of deep-rooted evils according to the criteria and proceduresprescribed in the current Constitution of Republic of Corea and required therights of the sovereigns of the Democratic Republic. Thus, the Candlelight CivicRevolution has been driven by the way of a two-track co-operation of thesovereign-civic politics and the governing organizations within the constitutionalorder of positive efficacy. And in the process of the sovereign-civic politics werejoined the conservative and the progressive, the right and the left as well as thepeople divided into provinces and localities with diverse. Eventually, in thecoming process of state-remodelling as the second phase of the Candlelight CivicRevolution it must and should be the Constitution that is the normative idea ofnational integration uniting the citizens of each kind with plural and diverseinterests into one national citizenry, while each article of the Constitutionoperates as the indicator of state reform.
