장애 청소년의 학대피해 억제를 위한 정책적 방안 모색 (A Study on the Political Measures for Reducing Abuse Damage of Disabled Youth)

초록

이 연구에서는 장애 청소년의 학대피해에 대한 유형과 실태를 분석하고 장애 청소년들의 학대피해 억제를 위한 정책 실무적 방안과 더불어 관련된 법, 제도적 지원 확대 방안, 그리고 다양한 사회적 위험관리 방안을 제시하고자 하였다.
또한 신체적 장애는 물론 정서장애나 행동장애 등으로 인해 학대나 범죄피해, 기타 사회적 부적응 등을 경험하고 있는 장애 청소년에게 종합적·전문적 치료·재활 서비스를 제공함으로서 장차 그들이 정상적 생활을 영위하고 건강하게 성장할 수 있는 구체적 방안을 모색하였다.
연구결과 장애 청소년의 학대피해를 억제하기 위해서는 다음과 같은 정책적 대안이 필요할 것으로 보인다. 첫째, 가칭 「장애인 학대피해 방지법」과 같은 일원화된 법률을 제정하여 장애인 학대행위에 대하여 가중 처벌하도록 하고 경찰 등 수사기관의 즉각적인 개입 근거를 마련하고 이후의 수사와 재판 과정에서 적절한 형사사법적 지원이 이루어질 수 있도록 해야 한다.
둘째, 형사사법기관 종사자들의 인식개선과 경찰의 역할 확대를 통해 장애 청소년 등 장애인 학대피해자들에 대한 적절한 보호와 지원이 이루어지도록 하고 장애 청소년을 대상으로 은밀하게 이루어지는 각종 학대행위의 조기 파악과 현장조사, 신속한 사건처리, 피해자에 대한 보호와 지원이 이루어지도록 해야 한다.
셋째, 장애 청소년 학대피해자를 위한 원스톱 지원센터 설치, 지방자치단체의 장애 청소년 담당 공무원 증원과 장애인 임용 확대, 발달장애 청소년 서비스 인력의 등록ㆍ인증제 도입, 장애인권익옹호기관 확대를 통한 장애 청소년 지원체계 강화, 장애 청소년을 위한 특수 교육기관의 증설과 학대피해 예방 교육 강화 등 사회적 지원체계를 확대해야 한다.
넷째, 장애 청소년 등 장애인 학대 예방 전수조사 체계 구축, 학대피해 장애 청소년을 위한 쉼터 개설과 지역사회 지향적 ‘준 탈시설화’ 추진, 학대 발생 장애인복지시설에 대한 처벌 강화, 장애인 학대 행위자 취업제한 제도 도입 등 장애 청소년의 학대피해 예방 및 피해자 지원체계를 확대해야 한다.

영어초록

This study aimed to analyze types and reality of abuse damage of disabled youth, and suggest a plan for expanding relevant legal and institutional supports with a variety of risk management measures as well as political measures for reducing abuse damage of disabled youth.
This study also devised specific measures for enabling them to live an ordinary life and grow healthily in the future by providing comprehensive·specialized treatment·rehabilitation service to disabled youth who are experiencing damage of abuse or crime and other social maladjustment due to emotional or behavior disorders as well as physical disabilities.
Study results show that political measures mentioned below are considered necessary for reducing abuse damage of disabled youth. First, it is necessary to carry out additional punishment against abuse of the disabled and prepare a basis for instant intervention of investigative agencies including police by enacting an unified law such as a tentative name「The Act on Prevention of Abuse Damage of the Disabled」, and provide a proper criminal justice support for the process of investigation and trial afterward.
Second, proper protection of and support for the victims of abuse of the disabled including disabled youth shall be enabled through awareness improvement of the workers of criminal justice agencies and expansion of police with early identification and field investigation of various actions of abuse made secretly against disabled youth, quick handling of cases etc.
Third, social support system such as installation of one-stop support center for the victims of abuse of disabled youth, increase of public officials of local governments in charge of disabled youth and expansion of appointment of the disabled, introduction of registrationㆍcertification system of service manpower for the youth with developmental disabilities, enhancement of support system for disabled youth through expansion of agencies protecting rights and interests of the disabled, increase of special education institutions for disabled youth and enhancement of education for preventing damage of abuse shall be expanded.
Fourth, systems to prevent damages of abused disabled youth and support victims such as construction of complete enumeration survey for preventing abuse targeting the disabled including disabled youth, installation of shelters for disabled youth victimized by abuse, promotion of local community-oriented ‘quasi-deinstitutionalization’, enhancement of punishment against welfare facilities for the disabled where abuse takes place, introduction of system limiting employment of the disabled abuse abusers shall be expanded.
