통합적 검역체계 구축을 위한 법정책적 측면에서의 호주검역법연구 (Study on Analysis of Quarantine Legislations and Systems in Australia for Building an Integrative Quarantine System)

초록

본 논문은 호주의 선진 검역 체계와 검역 현황을 살펴봄으로써 이를 통해 신종 인플루엔자 대유행과 같은 사태를 미연에 방지할 수 있는 보다 체계적이고 과학적인 검역 체계를 마련하기 위한 방안을 검토해 보고자 하였다.
호주의 검역은 검역법 1908(Quarantine Act 1908), 검역법 규칙 2000(Quarantine Regulation 2000), 검역법 고시 1998(Quarantine Proclamation 1998)을 직접적인 근거로 하여 다양한 운송수단 별 검역조사․소독 지침을 통해 이루어지고 있다. 또한 호주 검역의 특징은 연방 정부와 지방 정부간 그리고 연방 정부 내에서도 다양한 부처 간에 독립적이지만 상호보완적인 검역 업무를 수행하고 있다는 점이다. 즉 검역을 입국전 단계, 입국 단계, 입국 후 단계로 나누어 입국단계와 입국 후 단계는 엄격히 지방 정부의 영역으로 나뉘지만 동시에 국가비상사태시 등에는 연방 정부와 주 정부의 검역당국 간의 위계가 존재한다. 또한 호주는 보건노인부와 농림수산부의 협력 하에 인간검역과 식물, 동물 검역이 동일한 수준에서 다루어지고 있으며, 그 밖에도 입국과정에서 협력하는 이민국이나 세관도 함께 검역과정에 관여하고 있다. 또한 기본적으로 호주는 급격히 증가하는 국제 교류와 검역의 양적 증가에 대한 현실적인 자각에 따라 인력에 의존하던 근대적인 검역을 지양하고 일찍부터 자발적 검역 신고 및 위생 관리 체계를 구축하여 운영하고 있다. 한편 감염병 관리의 국제적인 공조를 위하여 인접 국가인 뉴질랜드와 전염병 관리를 위한 네트워크를 구축․운영하고 있다. 호주의 선진 검역 체계 분석을 통해 도출된 과학적이고 사전예방적인 통합검역체계를 구축하기 위한 방안은 다음과 같다. 세균성 감염병에서 바이러스성 감염병으로 검역대상 감염병 패러다임의 전환, 감염병별 검역조사 및 검역소독으로의 전환, 운송수단별 검역 체계로의 전환, 전자검역 우선 적용과 자발적 건강 상태 보고 체계로의 전환, 인간․동․식물 검역업무의 통합적 운영, 중앙 정부 및 지방 정부 그리고 정부 부처 간 검역 업무 범위의 재정립, 협의체 구성 및 검역의 전문성 제고 등이다.

영어초록

We studied how to build more systematic and scientific quarantine systems that are able to prevent pandemic influenza through the analysis of the advanced quarantine systems and quarantine situation in Australia.
The quarantine in Australia is based on the Quarantine Act 1908, the Quarantine Regulation 2000, and the Quarantine Proclamation 1998 and has various quarantine inspection and disinfection guidelines for each vehicle. As well, the Australian quarantine systems operate both independently and complementarily among the federal government and the state and territory health authorities, as well as various departments within the federal government. In other words, they classify three steps: pre-border, border, and post-border, and the state and territory health authorities have the power to govern in border and post-border areas. However, the federal government is superior to state and territory health authorities in situations such as public health emergencies, and so on. In the Australian quarantine systems, human quarantine and the quarantine of animals and plants are carried out together through the cooperation among the Department of Health and Ageing (DoHA), the Department of Agriculture, Fisheries, and Forestry (DAFF), the Immigration Office, and the Customs Office, which work together during the entry process. Australian quarantine systems are basically voluntary quarantine reporting and sanitary systems, refraining from old-fashioned quarantine systems which depend on human resources. This is because they realized that it was impossible to manage every increasing quarantine coverages. They also built a network (Communicable Diseases Network Australia New Zealand(CDNANZ)) and work together with New Zealand to manage infectious diseases internationally.
We suggest how to make an integrated quarantine system that is more scientific and preventive through the review of the quarantine systems in Australia : ① Paradigm shift of the quarantined infectious diseases from bacterial infection to virus infection, ② Preparation of quarantine inspections and disinfections for each infectious disease, ③ Preparation of quarantine inspections and disinfections in each vehicle, ④ Acceptance of Electronic Pratique - based quarantine system, ⑤ Shift of voluntary health reporting system, ⑥ Rebuilding of the quarantine affair coverage, ⑦ Establishment of consultative group and improvement of quarantine expertise
