개정 국제개발협력기본법에 대한 평가와 법정책적 과제 (An Evaluation of New Framework Act on International Development Cooperation and Challenges in Law and Policy)

초록

우리나라의 공적개발원조는 2009년 경제개발협력기구 개발원조위원회 회원국 가입과 2010년 「국제개발협력기본법」의 제정을 계기로 본격적으로 추진되고 있다. 현 정부는 국제협력 확대를 중점 과제 중 하나로 선정하고 그 규모를 계속하여 확대해가고 있다.
2010년 제정된 기본법의 입법목적은 공적개발원조 사업의 책임성과 효과성을 강화하는데 있었다. 그러나 기본법의 제정 이후에도 추진체계의 분절화로 인한 사업의 책임성과 효과성의 문제는 계속하여 제기되었고, 이와 관련된 원조 투명성에 대한 비판적 논의도 계속되었다. 이러한 문제점들을 개선하기 위해 그동안 몇 차례의 개정이 이루어졌고, 얼마 전인 2014년 10월에 가장 최근의 법 개정이 있었다. 개정 기본법은 원조투명성 증진, 국제개발협력위원회 의결권한 부여, 외부 평가, 전문인력의 양성 및 관리 등의 내용을 담고 있어, 국제개발협력 사업의 효율성, 효과성, 투명성을 높일 수 있을 것이라는 기대를 받고 있다. 그러나 여전히 많은 문제점들이 있고 이에 대한 개선을 필요로 한다는 비판 역시 존재한다.
이러한 상황 하에서 개정 「국제개발협력기본법」에 대해 평가하고 앞으로의 법정책적 과제를 제시해보는 것은 중요한 의의를 가질 수 있으며, 이 논문에서는 특히 원조 추진체계와 원조투명성을 중심으로 살펴보았다. 우리나라 국제개발협력 사업의 근본적 문제점인 추진체계에 대한 검토를 통해 사업의 효과성과 책임성을 담보할 수 있는 개선방안을 모색하고, 원조투명성의 실질적 증진을 위한 법정책적 과제를 제시하였다.
원조 추진체계와 관련하여서는 우리의 국제개발협력 목적과 현실에 맞는 추진체계의 설계가 필요하다는 것을 강조하였다. 분권화된 추진체계를 선택하는 경우 이로 인한 원조 효과성의 저하를 방지하기 위해 국제개발협력위원회와 주관기관의 조정 및 결정권한이 실질화되는 것이 필요하다. 또한 지방자치단체가 국제개발협력 사업을 수행하는 경우 그 역량 강화를 위해 조례의 제정과 전문성 강화가 필요하다. 원조투명성의 증진을 위해서는 현행 기본법이 공개대상 정보를 제한적으로 열거하고 있는 태도를 버리고, 원칙적으로 원조 정보를 공개함을 규정하고 비공개 사유를 명확히 하여야 한다. 또한 시행기관별 정보공개의 기준과 양식이 통일되는 것이 필요하다. 이와 함께 국제개발협력 사업의 정책 및 입법과정에 국민이 참여하여 공감대를 확보하는 것이 중요하다. 이러한 개선방안을 통해 단순한 규모의 확대가 아닌 국제개발협력 사업의 선진화와 체계화가 이루어지는 것이 필요할 것이다.

영어초록

South Korean government has been promoting Official Development Assistance after gaining OECD Development Assistance Committee membership in 2009, and through the enactment of “Framework Act on International Development Cooperation” in 2010. The government has set international development cooperation as one of the top priority policies and expanded its scale.
The legislative purpose of Framework Act, which was enacted in 2010, was to strengthen the effectiveness and accountability of Official Development Assistance. However, even after the enactment of New Framework Act, the effectiveness and accountability were not fully achieved due to the diversification and segmentation of implementation system, so concerns about the aid transparency was triggered.
In order to improve these problems, Framework Act was amended for several times, and the most recent amendment was made in October, 2014. The amended New Framework Act is expected to increase aid efficiency, effectiveness, and transparency, since it includes the strengthening of aid transparency, the approval of decision rights of Committee for International Development Cooperation, external evaluation, and the training and management of professional human resources. However, there still exist limitations and criticism, which needs improvement.
In this regard, it is essential to evaluate the New Framework Act and seek for improvement of law and policy. This article examines the New Framework Act particularly focusing on aid transparency and the diversification of implementation system. Through scrutinizing implementation system as a fundamental problem, implications of law and policy are provided in order to ensure aid effectiveness, accountability, and ultimately increase aid transparency.
First of all, considering the implementation system, it is necessary to redesign it to reflect the purpose of Korean Official Development Assistance. The segmented implementation system leads to lower aid effectiveness. In order to prevent this problem, the power of Committee for International Development Cooperation should be substantially guaranteed. Secondly, in case of Official Development Assistance of local government, related local ordinance should be enacted and specialized for capability development. Thirdly, in order to increase aid transparency, the framework act should state the disclosure of aid information in principle, and clarify the discretion of information disclosure, rather than restrictively enumerate subject to the disclosure. Fourthly, the standard and format of aid information of implementing agency should be unified. Lastly, public should be engaged in the Official Development Assistance policy-making and legislation procedure to gain the sympathy. Through these improvements, it would be possible to achieve the advancement and systematization of Official Development Assistance.
