정당의 공직선거후보자 추천에 관한 법정책적 고찰 (A law-political Research on the Recommendation of Candidates by Political Parties)

초록

정당은 국가와 국민 간의 정치적 의사형성을 매개하여 주는 중개자로서 기능하고, 국민의 정치적 의사를 형성하여 국가의사결정으로 연결하며, 선거를 통해 국가기관에 참여한다. 또한 정당은 민주적 기본질서에 부합하는 결사체로서 기능한다.
헌법 제8조 제1항에서는 “정당의 설립은 자유이며 복수정당제는 보장된다.”고 규정하여, 국민은 원칙적으로 국가의 간섭을 받지 않고 ‘정당을 설립할 자유’를 기본권으로 보장받고 있다. 동시에 헌법 제8조 제1항에서는 정당설립의 자유의 전제조건인 ‘복수정당제’를 보장하고 있다.
정당의 공직선거후보자 추천은 「공직선거법」상 규율대상인 ‘공직선거’의 중요 부분이기 때문에 법적 규율이 필요하며, 정당 공천에는 공직선거에 적용되는 헌법상 ‘선거원칙’이 적용되어야 한다. 「공직선거법」 제47조 제2항에서는 ‘민주적인 절차’에 따라 공천하라고 규정하고 있지만, 어떤 민주적 절차에 따라야 하는지는 규정하지 않고 있다. 「공직선거법」에 민주적인 절차가 어떠한 절차인지를 명확히 규정해야만, 정당도 당헌에 공천과정에 있어서 민주적인 절차를 규정하게 된다.
우리나라 주요 정당의 공직선거후보자 추천에 있어서 당 대표 등 당 지도부의 ‘하향식 공천 결정’은 배제되어야 한다. 당 대표 등 당 지도부의 ‘하향식 공천 결정’은 정당 활동의 민주성 요청에 배치되기 때문이다. 또한 공천과정에 있어서 당원의 의사가 제대로 반영될 수 있도록 당 대표나 최고위원회의 의사결정 전에 ‘당원총회’에서의 결정을 거치는 절차가 필요하다.
독일 연방선거법 제21조에는 당원총회, 대의원회의, 지역구후보자 공천시기, 지역구후보자 추천서 등을 규정하고 있다. 또한 독일 연방선거법에서 규정하고 있는 것처럼, 우리나라 「공직선거법」에도 선거일 58일 전에 비례대표 국회의원 후보자명부를 확정하고, 중앙선거관리위원회는 선거일 48일 전에 각 정당의 비례대표 국회의원 후보자명부를 공개하는 방안을 규정할 필요가 있다.

Political parties function as intermediaries that mediate political decision-making between the state and the people, form political decisions of the people to make national decisions, and participate in state agencies through elections. In addition, political parties function as associations that conform to the democratic fundamental order. Article 8 (1) of the Korean Constitution stipulates that “The establishment of political parties shall be free, and the plural party system shall be guaranteed.” In principle, the people are guaranteed the fundamental rights to ‘freedom to establish a political party’ without interference from the state. At the same time, Article 8 (1) of the Korean Constitution guarantees the plural party system, which is a prerequisite for freedom of political parties.
The recommendation of candidates by political parties an important part of public official election, so legal discipline is necessary. This is because the recommendation of candidates by political parties for public official election is subject to the rules of the 「Public Official Election Act」. In addition, the election principle must be applied to the recommendation of candidates by political parties under the Constitution. Article 47 (2) of the 「Public Official Election Act」 stipulates that recommendation of candidates by political parties be made in accordance with the ‘democratic process’, but does not specify which democratic procedures should be followed. Only if the democratic process is clearly defined in the 「Public Official Election Act」, the political parties will also define the democratic process in the candidate’s recommendation process.
In the recommendation of candidates by political parties for public official election by major political parties in Korea, the ‘top-down nomination decision’ of the party leadership, such as the party leader, should be excluded. This is because the ‘top-down nomination decision’ of the party leaders, such as the party leader, is against democracy in party activity. Also, in the recommendation process of candidates by political parties, it is necessary to have a procedure to go through a decision at the ‘general assembly of the party’ before the political party representative or supreme committee decides to reflect the wishes of the party’s member.
