초록

본고는 디자인의 ‘신규성’과 ‘창작 비(非)용이성’의 인적판단기준에 관한 것이다. 대부분의 나라에서 자국법에 따라 디자인보호요건으로 ‘신규성’과 ‘창작 비용이성’ 그리고 이와 유사한 개념으로서 ‘독특성’을 요구하고 있다. 일반적으로 신규성의 요건이 만족되기 위해서는 디자인은 새로운 것이어야 하고 기존 디자인과는 달라야 한다. 그런데 창작 비(非)용이성은 이러한 신규성과 밀접한 관련을 맺고 있다. 왜냐하면 창작 비(非)용이성의 판단은 신규성과 유사성의 기반에서 이루어지기 때문이다. 창작 비(非)용이성 유무는 선행디자인들에 비추어 사용자들에게 같은 인상을 주는 지의 여부 이를 달리 말하면 디자인이 속하는 분야에서 통상의 지식을 가진 자가 디자인을 쉽게 창작할 수 있는지의 여부에 따라 결정되기 때문이다. 문제는 이러한 신규성과 창작 비(非)용이성의 판단이 누구의 관점에서 이루어지느냐이다. 더욱이 신규성과 창작 비(非)용이성의 판단이 나라마다 다르고 사용되는 표현도 다르다. 예컨대 우리나라 디자인 보호법은 창작 비(非)용이성의 인적판단기준으로 ‘디자인이 속하는 분야에서 통상의 지식을 가진 자’를 규정하고 있으나, 그 개념에 대해서는 아무런 언급이 없다. 그러나 디자인보호법상 이러한 인적판단기준을 명확하게 정립하는 것은 디자인권자나 제3자에게 중요한 문제이다. 따라서 일본의장법이나 특히 공동체디자인규정을 참조하여 명확한 인적판단기준을 정립해야 할 것이다. 그리고 이러한 인적판단기준은 디자인권의 창작자의 보호와 디자인 이용자간의 이익균형점이 되어야 할 것이다.

영어초록

This article provides brief overview of criteria of subject in determination of ‘novelty’ and ‘non-creative easiness’ in Design. Key requirements for design protection in most countries are ‘novelty’ and ‘non-creative easiness’ or ‘individual character’ as depending on the particular national law. Generally speaking, for establishing novelty, a design must be new and the new design needs to vary from other existing designs. By the way, non-creative easiness question is directly related to the issue of novelty in design because an examination of characterizations of creative design is held from an angles of novelty and similarity based methode. Whether or not it has creative character depends on whether the design, compared to earlier designs, creates overall the same impression on the user, in other words, whether the design could have been easily created by a person with ordinary skill in the art to which the design pertains. The problem is that from whose point of view originality or similarity must be judged. Furthermore, what constitutes its novelty or non-creative easiness may differ from country to country and indeed the expression itself varies from country to country. For example, the reference entity for determining of non-creative easiness in Korean Designs Protection Act is a person ordinary skilled in the art of the design at issue. But Korean Designs Protection Act does not define the concept of the person ordinarily skilled in the art of the design. In addition, it should be noted that Korean Designs Protection Act does not stipulate the criteria of subject in determination of similarity. However, it is important for the owner of design right and the third party to set clear criteria of subject in determination of similarity through the creation of an explicit provisions in Korean Designs Protection Act. Concerning such a maintenance legislation, it may be well refer to the Japanese Designs Act or Community Designs Regulation in particular. The concept of criteria of subject in determination of novelty and non-creative easiness in Designs must be understood as balancing validity and enforceability of the design right.
