4차 산업혁명의 본격화와 함께 자유로운 국경 간 데이터이전을 보장하기 위한 통상규범의 필요성이 커지고 있다. CPTPP가 국경 간 데이터이전 조항을 최초로 의무화한 가운데, 미국과 유럽은 이를 규율하기 위한 통상규범에 대한 논의를 본격화하고 있다. 4차 산업혁명 기술의 총아인 자율주행차도 자율주행 알고리즘(AI) 개발 및 업그레이드, 지역․고객별 맞춤형 마케팅, 자동차 보험상품 개발, 신규 비즈니스 창출 등을 위해서는 빅데이터 수집․활용이 필수적이며, 이를 위해 자유로운 국경 간 데이터이전을 법․제도적으로 보장하는 것이 중요하다. 이에 이 논문은 자유로운 국경 간 데이터이전을 실효적으로 보장하기 위한 통상규범을 도출하기 위해 다음과 같이 검토를 진행하였다. 첫째, 기존 개인정보보호 원칙과 자율주행차 데이터 수집․활용간 균형과 조화를 모색하는 것이 어려울 수 있다는 점을 분석하였다. 둘째, 국경 간 데이터이전과 개인정보보호 문제에 대한 논의를 선도하고 있는 미국, 유럽연합의 개인정보보호법, 자율주행차 관련 법률을 분석하여 정책방향을 검토하였다. 셋째, 국경 간 데이터이전과 개인정보보호에 대한 통상규범 논의방향을 검토하기 위해 미국과 유럽연합의 통상정책을 분석하였다. 이를 토대로, 높은 수준의 국경 간 데이터이전을 보장하기 위한 시론적(試論的) 통상규범을 도출하였다. 시론적 통상규범은 ①데이터 활용 촉진을 위해 개인정보보호 핵심원칙에 대한 공통규범을 마련하고, ②개인정보 세분화 및 이에 따른 개인정보보호 수준의 차등적 적용을 기본방향으로 한다. 4차 산업혁명 시대의 가장 중요한 생산요소인 데이터의 국경 간 이전은 이제 거스를 수 없는 대세인 만큼, 통상규범 수립에 적극 대응하여 국익을 극대화하여야 할 것이다.

A Study on Trade Rules regarding Autonomous Vehicle: Legal Issues on Cross-border Data Flows

As the 4th Industrial Revolution is in full swing, the necessity of new trade rules which can ensure free cross-border data flows looms large. With the very first emergence of an obligatory provision for cross-border data flows under the CPTPP, the U.S. and European Union have started to fomulate new trade rules. Meanwhile, it is crucial for autonomous vehicles which are the result of technological integration to gather and utilize the Big Data in order to develop and upgrade the Artificial Intelligence, to devise customized marketing strategies, and to make new business opportunities. In order to maximize the benefits of the Big Data, it is of importance to ensure free flows of data based on the international legal framework. This paper reviews as followed to come up with new trade rules which can effectively ensure free cross-border data flows. First, this paper reaches a conclusion that it may be difficult to seek a reconciliation between principles for the personal information protection and gathering and utilization of data related with autonomous vehicles. Second, this paper analyzes personal information protection acts and laws on autonomous vehicles of the U.S. and European Union to review their policy directions. Third, this paper examines the trade policies of the U.S. and European Union to review the current trade rules on cross-border data flows and personal information protection. Based on the these analysis, this paper comes up with an experimental trade rule which ensures high level of cross-border data flows. The fundamental characteristics of the experimental trade rule can be summarized that 1)harmonized personal information protection principles which are legally-binding may enhance free cross-border data flows and 2)subdivided definitions of personal information and differential applications in terms of the level of protection may facilitate free cross-border data flows. Considering that the free flows of data which is the most important factor of production in the 4th Industrial Revolution era is an irreversible trend, it is momentous for Korea to actively deal with the formation of new trade rules.
