독일 도로교통법상 자동주행차의 규율에 관한 검토 (A Study on the Regulation of Automated Vehicles in German Road Traffic Act)

초록

세계시장에서 자동주행차 산업의 기술발전은 계속되고 있으며, 많은 국가들이 자동주행차의 상용화를 위한 법제를 마련하고 있다. 그러나 이러한 세계적 추세에 비해 우리나라의 입법적 대응은 더딘 편이라고 할 수 있으며, 이는 자동주행차 관련 국내산업의 발전과 세계시장에의 대응 및 국민들의 삶의 편의를 저해하는 결과를 가져올 수 있다. 이 논문은 이러한 문제의식에 바탕하여, 꾸준히 자동주행차에 관한 정책적․입법적 대응을 해 온 독일의 사례, 특히 독일 도로교통법의 개정논의와 관련 규정들을 검토함으로써 우리 법제에의 시사점을 찾아보는 것을 연구의 목적으로 한다.
논문은 크게 네 개의 장으로 구성된다. 먼저 Ⅱ장을 통해 자동․자율주행차의 개념에 대하여 알아본 후, Ⅲ장에서는 자동주행차의 규율을 위한 독일 도로교통법 개정과 관련하여 개정 전후의 정책적․입법적 논의들을 파악해본다. Ⅳ장에서는 개정된 도로교통법의 주요 내용을 분석하고 이에 대한 논의와 비판을 살펴본다.
이러한 검토내용을 바탕으로 V장에서는 자동주행차에 관한 독일 도로교통법의 규정내용과 관련 논의가 우리 법제에 시사하는 바를 정리하였다. 먼저 자동주행차의 이용에 관한 정책적․입법적 논의가 보다 본격화되어야 하며, 이를 위해 국제적 기술수준과 국제규범에 대한 고려, 범부처 민․관 협의기구의 실질적 운영, 국민의 수용성 제고 등이 필요함을 언급하였다. 다음으로 자동주행차에 관한 입법의 정비방안을 제안하였다. 먼저 현행법상 자율주행자동차라는 용어를 자동주행차로 대체하고, 현재의 기술수준을 포섭할 수 있는 내용으로 개념 정의가 이루어져야 함을 언급하였다. 자동주행차의 안전기준 및 운행허가의 법적 근거를 마련함에 있어서는 독일 도로교통법상의 규정내용을 참고하여 현행 「자동차관리법 시행규칙」 및 국토교통부장관 고시의 규정내용을 법률과 법규명령에 규정하는 방안을 제안하였다. 또한 자동주행차의 운전자에 대한 입법에 있어 운전자는 자동주행 시스템을 활성화한 사람이 되며, 운전자는 일반 자동차의 운전면허를 소지해야 함을 언급하였다. 마지막으로는 자동주행차가 고도의 기술과 전문성을 전제로 한다는 점에서 전통적인 법률유보이론의 적용을 통한 규율에 한계가 있음을 인식하고, 입법과정에서 행정규칙을 통한 법령의 구체화 문제, 법규명령에의 포괄적 위임의 문제 등이 충분히 논의되어 그에 대한 대응방안이 마련될 필요가 있음을 지적하였다.

영어초록

In response to the continuous technical development of automated vehicles in the global market, many countries try to make legislation for the commercialization of automated vehicles. However, in comparison with other countries, Korea is acting slowly to take legislative measures, which can result in limiting the development of domestic industry, the response to the global market and the convenience of people’s lives. Based on the awareness of this problem, the paper aims to review the case of Germany which has made constant efforts to prepare policies and legislation for regulating automated vehicles. Also, by analyzing not only the discussions about amending German Road Traffic Act to introduce regulation of automated vehicles but also the amended regulations in the Act, it suggests their implications for Korean legislation on automated vehicles.
The paper has four main parts from the second to the fifth chapter. First, in the second chapter it deals with the concept of automated and autonomous vehicles and in the third chapter the political and the legislative discussions before and after the amendment to German Road Traffic Act to introduce regulation of automated vehicles. In the fourth chapter, after interpreting the amended regulations in the Act, the paper introduces the concrete discussions and the criticisms on the regulations.
Based on the review in these chapters, in the fifth chapter, the paper suggests some implications of the regulation contents in German Road Traffic Act and the discussions related to them for Korean legislation on automated vehicles. First, more political and legislative discussions about regulating the use of automated vehicles should be in earnest begun - in specific such as about the international technical standards and the international regulations, the proper operation of a public-private consultation organization and the measures for improving public acceptance. Second, some legislative improvement measures must be taken. It is needed to use the term ‘Automated Vehicle’ instead of the term ‘Autonomous Vehicle’ which is used in the current legislation but is not enough for including various automation levels. Safety standards and operating permission of automated vehicles must be regulated not in Enforcement Rules of the Motor Vehicle Management Act and Notification by Ministry of Land, Infrastructure, and Transport but in Motor Vehicle Management Act itself and Enforcement Decree of the Act. As in the German Road Traffic Act, driver must be also the one who activates the automated driving system and have a general driving license. Finally, it should be considered that the application of the traditional principle of Law-reservation to regulating automated vehicles can be limited due to high technology and professionality in the area of automated vehicles. In the legislation process, it is necessary to discuss enough the issues of the concretization of legal norms through administrative rules and broad delegation to enforcement decrees.
