4차 산업혁명 관련 법정책 인식조사 (An Analysis of Perception on Law and Policy regarding the 4th Industrial Revolution)

초록

4차 산업혁명은 인공지능, 빅데이터 등 신기술로 촉발되는 초연결 기반의 지능화 혁명으로 인간의 삶의 방식에 대해 상상할 수 없는 수준의 근본적인 변화를 야기할 것으로 예측된다. 그에 따라 우리 정부는 4차산업혁명위원회를 2017년 설립하고 위원회를 중심으로 데이터 네트워크 산업, 헬스케어 산업, 스마트 산업(자동차, 공장 등), 도시 건설 산업, 물류 산업, 국방 산업, 교육 산업, 핀테크 산업 등 지능정보기술과 유관한 제반 산업 분야의 주요 정책에 대한 논의를 진행해 오고 있다. 다만 이러한 정책 구상에 있어서 정책의 민주적 정당성 확보를 위해 일반 국민들의 의견 수렴이나 직접적 참여 보장이 적절하게 이루어졌는지는 분명하지 않다. 사람 중심의 4차 산업혁명을 청사진으로 제시하고 있는 위원회의 근본적 목표를 고려할 때, 새로운 시대와 사회를 창조하는 4차 산업혁명과 관련하여 일반 국민이 정책결정에 관여할 수 있도록 그 의견 수렴에 위원회와 정부가 적극적으로 나서야 함은 당연한 것이다. 이러한 맥락에서 4차 산업혁명 관련 법정책에 대한 일반 국민의 인식을 파악하는 것은 중요한 과제이다. 4차 산업혁명 관련 법정책의 민주적 정당성 확보를 위한 사전 작업으로 이 연구에서는 법정책에 대한 대국민 인식 조사를 수행하였다. 구체적으로는 첫째, 4차 산업혁명 관련 법정책에 대한 기본적 인식 조사(정책 기조 및 구체적 정책들에 대한 지식 및 선호도 조사), 둘째, 관련 법정책 방향성 인식 조사(보완 사항･분야 인식 조사), 셋째, 입법(정책입안)과정에 참여 의사 조사(입법과정 민주성 인식 및 참여 의지 확인, 시민공동체 활동에 대한 인식 조사)를 비대면 인터넷 설문조사 형식으로 만 19세 이상의 성인남녀 1,000명을 대상으로 수행하였다. 우선 4차 산업혁명 관련 입법과정에 대한 참여 의사 설문조사를 통해, 일반 시민들은 정책결정과정이 민주적으로 이루어지기를 원하며 단순 참여를 넘어 결정의 주체가 되기를 희망하는 능동적이고 적극적인 입장을 가지고 있음을 확인할 수 있었다. 특히 4차 산업혁명 자체에 대한 관심도가 높고 관련 지식을 많이 알수록 정책결정 과정에의 참여 의지가 강하게 나타났는데, 이는 정책의 민주적 정당성을 확보하기 위해 시민 대상 홍보와 교육이 절실함을 보여준다. 다음으로 4차 산업혁명 관련 법정책에 대한 태도를 확인하는 설문조사를 통해, 일반 시민들은 기술개발로 인하여 개인이 접하게 되는 해악과 편익을 형량하여 법정책적 개입의 필요성을 결정하는 실용주의적 입장을 취한다는 사실을 확인할 수 있었다. 또한 4차 산업혁명 관련 분야 중 법정책적 개입이 필요한 분야에 대한 설문을 통해, 일반 시민들은 어느 정도 기술개발이 이루어져 현실화된 경우 비로소 법정책적 개입의 필요성을 논하는 다분히 현실주의적인 입장을 가지고 있음을 확인할 수 있었다. 나아가 일반 시민들은 헌법상 보장된 가치와 기본권을 실현하기 위한 노력이 4차 산업혁명이라는 대전환의 시기에도 그 정책입안 과정에서 여전히 근간이 되어야 한다고 강조한다.

영어초록

The fourth industrial revolution is a hyper-connected intelligence revolution triggered by new technologies such as artificial intelligence and big data, which is expected to cause a fundamental change in the way of human life. Accordingly, the Korean government established the Presidential Committee on the 4th Industrial Revolution in 2017 and has been discussing major policies related to intelligent information technology such as data network industry, healthcare industry, smart industry, etc.
However, it is not clear whether the opinions of the general public have been properly reflected into this policy initiative. Considering the fundamental goal of the Committee, which presents the fourth industrial revolution centered on people, it is a natural request for the Committee and the government to affirmatively guarantee public to participate in policy-making process and to secure democratic legitimacy of the policy. In this context, identifying the general public's perception on legal policies related to the fourth industrial revolution is an important task.
As a preliminary work to ensure democratic legitimacy of legal policies related to the fourth industrial revolution, this study conducted a survey of public awareness of legal policies regarding the fourth industrial revolution. The survey consisted of the following topics: first, a survey of basic perception on legal policies related to the fourth industrial revolution (a survey on public knowledge and preference for policy keynote and specific policies), second, a survey of an awareness on the direction of modification of relevant legal policies, third, a survey of willingness to participate in legislative process. The survey was conducted on a non-face-to-face Internet survey over 1,000 adults.
First of all, through a survey of willingness to participate in legislative process related to the fourth industrial revolution, we find ordinary citizens want the policy-making process to be democratic and to be the main body of decision-making process beyond just one of participants. In particular, the higher the interest in the fourth industrial revolution itself and the more relevant knowledge, the stronger the willingness to participate in the policy-making process. This indicates public education is urgently needed to implement democratic requests for policy participation. Next, a survey of an awareness on the direction of modification of relevant legal policies shows that ordinary citizens take a pragmatic stance to determine the need for legal intervention by risk-benefit analysis. In addition, we identify ordinary citizens have widely realistic positions that they become keenly aware of the need for governmental intervention only when technology development becomes a reality and we begin to experience the benefits and risks of technology development. Furthermore, ordinary citizens stress that efforts to realize constitutional guaranteed values and basic rights should still be the foundation in the policy-making process even during the great transition of the fourth industrial revolution.
