위험사회에서 국민의 안전보호의무를 지는 보장국가의 역할 - 현행 안전법제에 관한 고찰을 겸하며 - (The Role of the Guaranteeing State Assuming the Safety Protection Obligation of Citizens in the Risk Society)

초록

법적 개념으로서 위험과 리스크의 관계는 3단계 모델과 2단계 모델이 주장되고있다. 위험은 개연성과 관련된 개념이고, 리스크는 가능성과 관련된 개념이므로 2단계모델이 타당해 보인다.
제3의 길인 보장국가는 국가 스스로 공적 과제를 직접 수행하기도 하지만, 되도록민간과 협력하여 또는 민간이 직접 공적 과제를 이행하도록 하는 국가를 말한다. 따라서 보장국가는 날씬한 국가 내지 최소국가를 지향한다. 그러나 보장국가는 탈규제가 아닌, 더 까다로운 규제를 요구한다. 반면, 보장국가에서는 국가와 민간의 밀접한상호 협력이 강화되고 민간이 공적 과제를 충실히 이행하도록 국가가 적극적으로협력하고 구조화한다. 보장국가에서의 책임은 크게 이행책임과 보장책임으로 나뉜다. 그리고 보장책임은 공급책임, 수용책임, 완충책임으로 나뉜다. 민간은 이행책임만을 지며, 국가는 이행책임과 보장책임을 진다.
현행 우리나라 재난 및 안전관리 기본법은 선언적인 규정이 많고 실효성 있는 집행을 담보하지 못하고 있다. 재난의 유형에 따른 구체적인 재난 관리 방안을 규정할수 있는 근거규정을 둘 필요성이 있다. 또한 국민안전처가 모든 재난을 총괄하고 책임질 수 있는가에 대한 근본적인 대답이 필요하고, 그 대안을 모색하여야 한다. 국민이 스스로 안전 추구 노력을 하도록 법제도화해야 하며, 재난 및 안전관리 기본법은 관(官) 주도에서 민관(民官) 협력체제로 개정되어야 한다.

영어초록

There are the three-step model and the two-step model with respect to the divisionof danger and risk. While danger is associated with the probability, risk is associatedwith the possibility. The two-step model seems to be the more valid in terms of apractical approach.
There is not only a tension but also a common intersection between liberty andsecurity. Freedom should not be always sacrificed in order to ensure safety. Thisidea will lead to unsafety by having unpredictability of the state police power. Thebalance and harmony ought to be maintained between liberty and security.
The guaranteeing state as a third way is the state performing public tasks in cooperationwith the private sector. The guaranteeing state, thus, aims for a slim state ora minimal state. However, the guaranteeing state is not deregulation but the moredemanding regulations. On the other hand, the guaranteeing state plays a role to activelycollaborate with the private sector, closely cooperate with the private sectorand strengthen the private sector to perform public tasks faithfully. Responsibility ofthe guaranteeing state is divided into the implementation responsibility and the guaranteeingresponsibility. The guaranteeing responsibility can be divided into supply responsibility,acceptance responsibility, buffer responsibility. While private sector isresponsible for the implementation responsibility, the guaranteeing state shall be responsiblefor the implementation responsibility and the guaranteeing responsibility.
With regard to the current safety legislation, the Framework Act on the Managementof Disasters and Safety does not guarantee the effectiveness of enforcement in manya declarative rules. There is a necessity to regulate the applicable provisions based on disaster management plans in accordance with the types of disaster. In addition,the Ministry of Public Safety and Security must give fundamental responses to managingand being held accountable for all the disasters, and seek for the alternatives.
The institution has to be established in order that the public make their own effortsto pursue their safety. In conclusion, the Framework Act on the Management ofDisasters and Safety must turn a state-centered into a cooperation system betweenpublic and private sectors.
