초록

행정청은 행정질서 의무위반자에 대하여 그 의무이행을 간접적으로 강제하여 행정행위의 실효성을 확보하기 위하여 제재수단으로써 행정벌을 부과하고 있다. 행정벌은 행정형벌과 행정질서벌로 나누어진다.
오늘날 사회변화와 시대적 흐름에 따라 행정법상의 행정질서 의무위반행위에 대한 제재가 비범죄화․탈범죄화적 측면이 강조됨에 따라 행정벌의 중심이었던 행정형벌이 행정질서벌로 전환되고 있다. 그러나 행정질서벌을 부과함에 있어서 부과의 대상, 기준, 금액을 정함에 많은 문제점과 혼란을 야기 시키고 있다. 특히 행정질서벌의 과잉, 행정질서벌의 과중한 액수의 산정, 제재의 중복성 등에서 문제점이 제기되고 있다. 이런 상황 속에서 더군다나 행정형벌의 행정질서벌로의 전환은 행정질서벌의 범람, 또는 형벌의 행정질서벌에로의 도피현상을 야기할 수 있는 위험성이 커지고 있다. 이러한 상황 속에서 행정행위의 실효성 확보보다는 국민의 기본권보호와 제재의 효율성 을 위하여 행정형벌의 행정질서벌로의 전환의 정립을 위한 방안을 검토하는 것도 중요하며, 연구해볼만한 과제이다. 따라서 이러한 맥락에서 행정형벌의 행정질서벌로의 전환에 있어 문제점을 제기하고 전환의 정립방안에 관하여 고찰하였다.
