경찰의 정신질환자 강제입원에 관한 연구 (A Study on the Forced Hospitalization of Mental Patients by the Police)

초록

지난 2019년 경남 진주에서 조현병을 앓던 정신질환자가 5명을 숨지게 하고 18명을 다치게 하는 사건이 발생하였다. 현재 우리 사회는 구조적 환경 변화 등으로 정신질환이 늘고 있고, 위와 같이 정신질환 범죄 또한 증가하고 있다. 그리고 경찰의 정신질환자에 대한 정신건강복지법상 강제입원도 빈번해 지고 있다. 그러나 2019년 경남 진주 사건에서 경찰의 정신질환자에 대한 조치와 강제입원의 실효성에 대해 문제가 제기되었다. 그래서 이번 연구에서는 경찰의 강제입원에 대해 다음과 같이 제언하고자 한다. 첫째, 경찰청 설명서 정신질환자 판단 부분은, 현행 정신건강복지법 체계와 맞게 정신질환자 의심 또는 추정으로 수정하여야 한다.
둘째, 응급입원의 실효성 확보를 위해서는 24시간 운영 가능한 광역 응급입원 의료시스템을 구축하여야 하고, 셋째, 행정입원을 활성화하기 위해서는 관련 기관과의 협업체계 구축 및 해당자의 자료를 공유하는 것이 필요하며, 응급입원 및 행정입원에 대한 개선안을 현실화하기 위해서는 정신건강 행정기관 인원 증원이 필수적이고, 마지막으로 현장 경찰관에 대한 지속적인 교육․훈련과 정신질환 관련 부서 경력자의 특별채용도 정책적으로 검토할 필요가 있다.

영어초록

Last 2019, in Jinju, Gyeongnam, a mental patient with schizophrenia killed 5 people and injured 18 people. Currently, in our society, mental disorders are increasing due to changes in the structural environment, and crimes with mental disorders are also increasing. In addition, compulsory hospitalization by the police under the Mental Health Welfare Act for mental patients is also increasing. However, in the 2019 Jinju case in Gyeongnam, a question was raised about the effectiveness of the police's actions against mental patients and the effectiveness of forced hospitalization. So, in this study, I would like to suggest the following for forced hospitalization by the police.
In our society, mental illness is increasing due to structural environmental changes. As a result, crime is also increasing.
Therefore, the crisis intervention of the mental patients by the police is expected to increase in the future. Accordingly, in this study, I would like to suggest the following about the crisis intervention(forced hospitalization) under the Mental Health and Welfare Act.
First, in the manual of the National Police Agency related to judging mental patients, it should be revised as suspected or estimated metal patients in accordance with the current mental health and welfare system and significant limitations should be added to the independent daily life rather than the past history of the mental illness. Second, in order to secure the effectiveness of emergency hospitalization, a wide area emergency medical system that can be operated for 24 hours should be established. Third, in order to secure the effectiveness of administrative hospitalization, it is necessary to establish a collaborative system with related organizations and accumulate sufficient data of the relevant persons. And in order to realize the recommendations for emergency hospitalization and administrative hospitalization, it is essential to increase the number of the staff in mental health agencies. Lastly, there is a need for continuous education and training for field police officers, and a policy review of special recruitment of workers with mental illness-related departments is also necessary.
