가처분과 동시에 이루어진 간접강제의 법적 성격과 불복방법 (Legal Nature and Appeal Method of Indirect Compulsory Enforcement Issued Simultaneously with Provisional Disposition)

초록

판례와 학설은 임시지위가처분을 명함과 동시에 간접강제결정을 할 필요성이 인정되는 경우 임시지위가처분과 간접강제결정을 함께 명할 수 있다고 보고 있다. 다만 임시지위가처분과 동시에 결정된 간접강제에 대하여 즉시항고로 불복할 것인지 보전이의·취소로 불복할 것인지에 관하여 학설이 대립하고 있고, 하급심의 입장도 정리되어 있지 않다.
이 글은 논의의 전제로 절차적 가능성과 필요성의 측면에서 임시지위가처분 및 간접강제의 동시결정이 허용되어야 한다는 점을 확인한다. 나아가 임시지위가처분과 동시에 결정된 간접강제에 대한 불복방법이 무엇인지에 관한 즉시항고설과 보전이의·취소설의 대립과 논의의 실익이 무엇인지 살펴보고, 대법원 2005. 1. 31.자 2004마1057 결정, 대법원 2011. 4. 26.자 2010마1982 결정 및 대법원 2007. 6. 14.자 2006마910 결정을 위주로 대법원의 입장을 정리하며, 하급심 결정례를 분석한다.
이를 기초로 하여, 동시결정 간접강제의 법적 성격을 민사집행법 제305조 제1항의 신청목적을 이루는 데 필요한 처분으로 볼 것인지, 아니면 가처분결정을 집행권원으로 하는 집행처분으로서 민사집행법 제261조의 간접강제라고 볼 것인지 살펴 후자가 타당함을 입증한다. 또한 동시결정 간접강제 즉시항고의 방법으로 불복하여야 한다는 것을 논증하고, 관련 쟁점에 관하여 필자의 견해를 제시한다.
추가적으로 본안판결과 동시에 간접강제를 명할 수 있는지 살펴보고, 이를 허용할 경우 그 법적 성격을 어떻게 규정하여야 하는지에 관하여도 논의해본다.

영어초록

According to judicial precedents and academic theories, a provisional disposition and an indirect compulsory enforcement order can be issued at the same time if there is need to take an indirect compulsory enforcement procedure together with a provisional disposition to fix a temporary position. However, academic theories, as well as lower courts, vary regarding whether to object via an immediate appeal or to file an objection or revocation relating to an indirect compulsory enforcement order that was simultaneously issued with a provisional disposition.
As a prerequisite for discourse in this paper, the author is of the view that a provisional disposition and an indirect compulsory enforcement order ought to be simultaneously permissible from the perspective of procedural availability and necessity. Furthermore, the paper explores the argumentative debate with respect to the differences between, and the practical benefits of, the methods of appeal against an indirect compulsory enforcement order that was issued together with a provisional disposition, namely, objection through an immediate appeal and request for an objection or revocation. Also, this paper examines the Supreme Court’s stance on the matter in view of the following judicial precedents Supreme Court Order 2004Ma1057 Dated January 31, 2005; Supreme Court Order 2010Ma1982 Dated April 26, 2011; and Supreme Court Order 2006Ma910 Dated June 14, 2007 and analyzes the orders rendered by lower courts.
Based on the foregoing discourse, the author seeks to establish whether the legal nature of the simultaneous issuance of an indirect compulsory enforcement ought to be deemed as a disposition necessary to realize the purpose of request as prescribed by Article 305(1) of the Civil Execution Act, or whether a provisional disposition order ought to be regarded as an indirect compulsory enforcement of an executory disposition with an enforcement title as stipulated by Article 261 of the same Act. The author attempts to prove the validity of the latter.
Moreover, this paper seeks to examine whether an indirect compulsory enforcement can be ordered at the same time as the decision on the merit and, if deemed so, discuss ways to set the legal nature of the same.
