국가인권위원회의 조사구제 분야 개선방안에 관한 소고 (A Study on Measures to Improve the Individual Complaint Process of the National Human Rights Commission of Korea)

초록

국가인권위원회는 2001년 설립된 이래 우리 사회의 인권증진을 위해 많은 일을 했다. 그 중에서도 인권위는 인권 피해자가 진정을 하였을 때 그 조사와 구제를 통해 피해자의 인권보호에 큰 기여를 했다. 그럼에도 몇 가지 분야에선 시급히 개선하지 않으면 안 되는 결함도 나타냈다. 무엇보다 인권위의 조사구제 기능의 본질 곧 정체성을 확립할 필요가 있다. 인권위의 조사구제 기능은 사법기관에 의한 인권구제를 단순히 보충하는 것이 아니다. 종래 인권위의 조사구제 기능을 ‘사법에 대한 보충성’이라고 이해했다면, 이제는 이를 좀 더 적극적으로 해석해 ‘사법에 대한 보완성’의 원칙으로 정립해야 한다. 이와 함께 인권위법 여기저기에 산재하는 ‘인권침해’라는 용어의 올바른 정립도 필요하다. 이 용어가 인권위 관계자나 인권위 업무에 밝은 소수의 사람들 사이에서만 이해되는 개념으로 사용되는 것은 인권위의 여러 기능을 활용해야 하는 국민에겐 적절치 않다. 인권침해란 차별행위를 포함하는 것이지, 오로지 ‘국가기관 등이 한정된 기본권을 침해한 경우’만을 의미한다고 보아선 안 된다. 인권위의 조사구제 기능의 정체성과 인권침해에 대한 개념을 정립한 후, 시급히 관심을 가져야 할 것은 현행법의 조사대상과 각하사유를 점검하는 일이다. 인권위 설립 초기부터 이미 논쟁의 대상이었지만 이제 20년의 경험을 갖고 이들 문제를 정리해야 하는 시점이다. 그런 차원에서 현재의 조사대상과 각하사유는 많은 인권침해 피해자들을 인권위가 외면하는 원인을 제공하고 있다. 적절하게 개선하지 않으면 안 될 상황에 이르렀다고 판단된다. 이 논문은 이러한 취지에 따라 결론적으로 인권위 조사구제 분야의 새로운 계기를 만들기 위해 인권위법 개정안을 제안하고자 한다.

영어초록

Since its establishment in 2001, the National Human Rights Commission of Korea(NHRCK) has done a lot to promote human rights in our society. Among them, the NHRCK has contributed a lot to the protection of human rights victim s by investigating and providing relief when they complained. Nevertheless, some areas showed deficiencies that urgently needed to be improved. Above all, the NHRCK's investigative and remedial function needs to establish the identity of its function. The NHRCK's investigative and remedial function is not merely supplementary to human rights remedies provided by judicial agencies. If in the past, the NHRCK's function of investigative relief was understood as “supplementary to the judiciary,” it should now be interpreted more positively and established as the principle of “complementary to judiciary.” At the same time, it is necessary to correctly establish the term “human rights violations” that are scattered throughout the NHRCK Act. The use of this term as a concept that is understood only among NHRCK officials or a small number of people who are knowledgeable in the work of the NHRCK is not appropriate for citizens who need to utilize the various functions of the NHRCK. Human rights violations include acts of discrimination and should not be taken to mean only “cases in which state institutions have violated limited fundamental rights.” After establishing the identity of the NHRCK's investigative and remedial function and the concept of human rights violations, what should be of urgent interest is to examine the subject of investigation and the reasons for the dismissal under the current law. It has already been the subject of debate since the beginning of the NHRCK Act, but now it is time to sort out these issues with 20 years of experience. In this regard, the current subject of investigation and the reasons for the dismissal provide a reason for the NHRCK to turn away many victims of human rights violations. It is judged that we have reached a situation where we must make appropriate improvements. In line with this intent, this paper proposes amendments to the NHRCK Act in order to create a new opportunity in the field of investigation and relief by the NHRCK.
