제헌헌법 제16조 교육조항의 성립과정에 관한 연구 (A Study on the Establishment Process of the 16th Article Education Clause of the Constitution of 1948)

초록

이 글의 목적은 제헌헌법 제16조의 성립과정에 대한 검토를 통해서 이교육조항의 의미와 우리 교육법제의 출발점을 살펴보려는 것이다. 제헌헌법 제16조의 교육조항의 성립과정은 제헌헌법의 다른 조항들과 마찬가지로 크게 세 단계를 거쳤다.
첫째는 해방이전에 대한민국임시정부에서의 헌법관련 문서들에서 나타난 교육관련 논의이다. 제헌헌법의 논의과정에서 특히, 교육조항의 성립은대한민국임시정부 헌법문서들의 계보를 잇고 있으며, <대한민국건국강령>의 건국 장 교육조항에 직접적으로 이어진다. 건국강령은 당시의 중국에서 논의된 여러 헌법문서의 영향을 받았으며, 교육을 중시하는 조소앙의삼균주의가 발현된 것이기도 하다. 둘째는 해방 이후에 제기된 여러 헌법안들에 나타난 교육에 관한 논의들이다. 해방 이후의 헌법안은 예외 없이교육조항을 포함하고 있었다. 이는 당시의 헌법초안자에게 교육중시가 건국의 이념으로 인식되고 있었다는 점을 의미한다. 셋째는 제헌국회가 구성되고 헌법기초위원회와 국회본회의에서 헌법안을 기초하고 이를 심의하는 단계이다. 제헌국회에 제출된 헌법초안은 그간의 교육조항 논의와달리 한 조항에 국한되는 교육조항을 담고 있었다. 이에 대해서 6개의 수정안이 제안되었으며, 주로 의무교육의 범위에 대한 것이었다. 당시의 정부상황을 고려한 현실론이 대세를 이루어 의무교육을 초등교육을 한정하고 이를 확장가능성을 둔 타협안이 가결되었다. 이것이 제헌헌법 제16조교육조항이다.
비록 간략한 한 조로 제헌헌법의 교육조항이 성립되었지만 그간의 수많은 헌법안에서 나타난 교육조항에 대한 논의는 1949년의 교육법 제정과정에서 고스란히 다시 나타나며, 교육법의 주요내용이 되었다. 이후 9차례에걸친 헌법 개정을 거쳐 현행헌법에 이르기 까지 제헌헌법 제16조의 교육조항의 골격은 그대로 유지된다.

영어초록

This article aims at studying the meaning of the 16th article education clause of the Constitution of 1948 and start point of our education legal systems by reviewing the establishment process of this clause. It had gone through three steps likewise the other of clauses of the Constitution of 1948.
The first step was the discussion about education showing in constitution documents of the Provisional Government of the Republic of Korea before the liberation of 1945. Especially the establishment of education clause of the Constitution of 1948 continued the constitution documents of the Provisional Government and got directly connected to education clauses of the chapter of establishment of government, the Essential Points for Establishment of the Republic of Korea on 1941.
The Essential Points fell under the influence of many constitution documents in discussion about the enactment of the Constitution of the Republic of China of those days. And also the three principles of equality by Cho So Ang had a decisive effect on education clauses of the Essential Points. The second step was the discussion about education showing in constitution drafts after the liberation of 1945.
Constitution drafts after 1945 included education clauses without exceptions. This means the serious consideration of education was perceived as the ideal of government establishment to constitution drafters. The third step was reviewing the Constitution Draft proposed by the Committee of the Constitution Drafting in the National Assembly [the Constitutional Making Assembly]. This Constitution Draft included just one article of education clause unlike the discussion about education clauses. Six amendments on the education clause of the Constitution Draft were proposed to the National Assembly. That were mainly concerned with the scope of compulsory education. The compromise proposal that the compulsory education limited into the elementary education but leaving the possibility of enlargement was passed in the National Assembly, because of the realism considered the situation of government. This was the 16th article education clause of the Constitution of 1948.
The discussion about education clause of so many constitution drafts was re-showed in the enactment of the Education Act of 1949 and became main contents of it. The frame of the 16th article education clause of the Constitution of 1948 maintains to the Constitution of 1987passing through nine times of the constitution amendments.
