군 성폭력범죄 대응의 문제점과 개선방안에 관한 연구 (A Study on the Problems and Improvements of Military Sexual Violence Crimes)

초록

성폭력범죄는 피해자의 영혼을 파괴하고 외상 후 스트레스 장애를 유발하여 피해자가 극단적 선택을 하게 만드는 심각한 범죄이다. 범죄로 인한 신체적 피해는 치료하면 완치가 되지만 정신적 피해는 완치가 되지 않고 평생을 괴롭힌다. 이러한 범죄가 군에서는 잊을만하면 발생하고 있고, 범죄 발생에 대한 수사 및 재판부의 잘못된 대응으로 피해자는 2차 피해를 당하고 있다. 이에 성폭력범죄 대응의 문제점을 지적하고 그 문제에 대한 대응방안을 논의하는 것이 연구의 목적이다.
연구의 방법은 선행 연구논문, 연구보고서, 인터넷 자료, 통계 등을 바탕으로 군 성폭력범죄 발생실태, 군사법원과 민간법원의 처벌실태 등을 비교평가 한다. 처벌에 대한 비교평가 후 차이가 있다면 그 원인이 무엇인지 살펴보고 대응방안을 모색한다. 형법에는 있지만 군형법에는 없는 처벌규정을 살펴보고, 이로 인해 처벌이 되지 않는 사례가 있는지 여부를 파악한다. 파악 후 처벌규정의 흠결이 있다면 입법부에 제정을 촉구하여 입법부가 조속한 법률규정을 마련하도록 한다.
연구결과 군사법원이 있는 부대의 지휘관은 수사 및 재판에 영향력을 행사할 수 있으므로 군사법원을 폐지해야 한다. 그것이 어렵다면 성폭력범죄에 대해서는 국방부 소속으로 성폭력 전담 재판부 하나를 두고 이동에 따른 제약을 해소하기 위해 원격화상재판시스템을 도입하여 재판할 필요성이 있다. 군사법원은 민간법원에 비해 유기형 선고비율이 18.2% 낮게 나타났는데, 그 원인은 군인연금법에 있으므로 군인연금법 개정이 필요하다. 업무상 위력에 의한 간음죄가 형법에는 있는데 군형법에는 없다. 이로 인해 관련 범죄가 발생했지만 법률의 흠결로 처벌되지 않으므로 법률제정이 필요하다. 수사과정에서 잘못된 대처로 성폭력범죄 피해자가 2차 피해를 당하고 있으므로 성폭력범죄 전담 수사팀을 신설하여 대응하는 것이 필요하다. 성폭력 예방교육이 예산부족, 전문강사 교육기피 등의 이유로 잘 이루어지지 않고 있으므로 AI 로봇을 이용한 성폭력 예방교육을 실시하는 것도 고려해볼 필요가 있다.
결론적으로 군 성폭력범죄는 끊임없이 발생하지만 위계질서로 인해 가해자의 협박, 회유 등으로 은폐되기가 쉽다. 여군을 전우로 보지 않는 한 성폭력범죄는 근절되기 어렵고, 이는 전투력 손실과 국가적 낭비로 이어질 수 있다. 군 성폭력범죄 피해자에 대한 관련자의 잘못된 대처는 피해자를 극단적 선택으로 몰고 갈 수 있다. 이러한 성폭력범죄에 대해 국방부의 보여주기 식 대응방안은 실현 가능성이 없어 피해자의 좌절과 실망감을 높일 뿐이다. 따라서 성폭력범죄 피해자의 피부에 와 닿을 수 있는 실현 가능한 해결책을 제시하여야 한다.

Sexual violence is a serious crime that destroys the victim's soul and causes post-traumatic stress disorder, causing the victim to make an extreme choice. The physical damage caused by crime is completely cured, but mental damage is not completely cured and bothers for life. Such crimes are occurring in the military when they are about to be forgotten, and victims are suffering secondary damage due to the investigation into the crime and the court's wrong response. The purpose of the study is to point out the problems of responding to sexual violence crimes and to discuss ways to respond to them.
Based on prior research papers, research reports, Internet data, and statistics, the method of research compares and evaluates the incidence of sexual violence in the military and civil courts. After a comparative evaluation of punishment, if there is a difference, examine what causes it and find ways to respond. It examines the punishment regulations that are in the criminal law but not in the military law, and determines whether there are cases where this does not result in punishment. If there is a flaw in the punishment regulations after identification, the legislature shall urge the legislature to enact them so that the legislature can prepare legal regulations as soon as possible.
As a result of the study, the commander of the unit where the military court is located can exert influence on investigations and trials, so the military court should be abolished. If that is difficult, it is necessary to have a court dedicated to sexual violence under the Ministry of National Defense to introduce a remote video trial system to resolve restrictions on movement. Military courts showed an 18.2% lower rate of abandonment sentences than civilian courts, and the cause is the Military Pension Act, so it is necessary to amend the Military Pension Act. There is a crime of adultery due to occupational power in the criminal law, but it is not in the military criminal law. As a result, related crimes have occurred, but laws need to be enacted because they are not punished for defects in the law. Since victims of sexual violence crimes are suffering secondary damage due to incorrect response during the investigation process, it is necessary to establish an investigation team dedicated to sexual violence crimes to respond. Since sexual violence prevention education is not well conducted due to lack of budget and avoidance of professional instructor education, it is also necessary to consider providing sexual violence prevention education using AI robots.
In conclusion, military sexual violence crimes are constantly occurring, but due to hierarchy, it is easy to be covered up by threats and conciliatory acts by perpetrators. Sexual violence crimes are difficult to eradicate unless female soldiers are considered comrades, which can lead to a loss of combat power, leading to a national waste. The wrong handling of victims of sexual violence in the military can lead them to extreme choices. The Ministry of National Defense's demonstrative response to such sexual violence crimes is not feasible, which only increases the frustration and disappointment of victims. Therefore, feasible solutions should be presented that can touch victims of sexual violence.
