지역대표형 상원제 도입의 공법상 주요 쟁점 (Major legal issues in the introduction of a Regional representative Senate system)

초록

각국은 역사적 배경에 따라, 현실적 필요에 따라 국회를 양원제로 운영해 왔다. 단원제 국회인 우리의 경우, 중앙정부 중심의 권력구조 하에서 지방의 의견이 국정에 제대로 반영될 수 있는 제도적 장치가 미약하다. 헌법에서 보장하고 있는 지방자치의 가치와 이념이 제대로 구현되기 위해서는 무엇보다 최종적 정책 결정권한을 가진 국회의 구성과 운영을 통해 제도적으로 구현될 수 있도록 방안을 마련하는 것이 필요하다. 헌법에서 보장하고 있는 지방자치제가 제대로 기능하기 위해 권력구조 곳곳에 지방분권적 체계를 만들어 국가운영과 정책결정이 지방분권적으로 이뤄질 수 있도록 규범화하는 것이 중요한데, 가장 확실한 권력구조의 변화로서 입법기관인 국회에 지방대표가 구성원이 되어 지방의 의견을 제시하고 반영할 수 있도록 지역대표형 상원을 도입하는 것이 필요하다.
민주주의의 관점에서 지역대표성과 민주적 정당성을 어떻게 확보할 것인지에 따라 지역대표형 상원의 직접 선출 여부와 권한의 크기, 소환제의 적용 등이 달라질 수 있다. 또한 권력분립의 관점에서 상원의 위상에 따라 그 권한의 배분이 달라질 수 있다. 상원이 국가의 통치구조에서 실질적인 견제와 균형의 추로서 기능할 수 있도록 하기 위해서는 하원과의 관계에서 대등하다고 평가할 수 있는 수준의 권한이 배분될 필요가 있다.
현재 우리나라의 단일국가체제, 대통령제라는 통치구조를 전제로 하고, 지역대표형 상원을 구성하기 위해 검토해야 하는 각 쟁점을 구체적으로 살펴보았다. 하원에 대응하여 실질적인 기능을 할 수 있는 상원의 위상, 민주적 정당성 측면에서는 주민직선이 바람직하겠으나, 지역대표성의 강조 차원에서는 간접선거도 고려할 수 있다. 또한 선출방식에 따른 주민소환제의 적용 여부, 상원의원 선출을 위해 선거구의 획정 방식과 의석 배분, 상원의 권한으로서 입법권 및 개헌안 제안, 재정권, 권력기관의 구성 권한 등 상원의 권한 실질적 권한 배분, 하원의원과 교차선출이 가능하도록 임기의 차별화, 상원의 명칭으로서 ‘참의원’보다는 ‘지방원’ 등 정체성이 부여될 수 있는 방안 등을 제시하였다.
이러한 지역대표형 상원의 설치는 지방분권의 촉진, 정치체제의 선진화 등에 기여할 수 있음과 동시에, 국회 내에서의 권력분립을 실현하고, 중앙권력과 지방권력 간의 견제와 균형을 유지하는 중요한 역할을 수행할 수 있을 것이다.

영어초록

Each country has operated a bicameral legislature based on historical background and practical needs. In the case of our unicameral legislature, the institutional mechanisms to properly reflect local opinions in national affairs are weak under a central government-centric power structure. To properly implement the values and ideals of local autonomy guaranteed by the Constitution, it is necessary to prepare measures to institutionalize them through the composition and operation of the National Assembly, which holds the ultimate policy-making authority. To ensure the proper functioning of the local autonomy system guaranteed by the Constitution, it is important to create a decentralized system throughout the power structure so that national administration and policy-making can be carried out in a decentralized manner. As a clear change in the power structure, it is necessary to introduce a regional representative Senate in the legislative body, the National Assembly, where local representatives can become members and present and reflect local opinions.
From the perspective of democracy, the direct election of the regional representative Senate, its authority, and the application of recall systems can vary depending on how regional representativeness and democratic legitimacy are secured. Additionally, from the perspective of the separation of powers, the distribution of authority can differ based on the status of the Senate. To ensure that the Senate can function as a real mechanism of checks and balances within the national governance structure, it is necessary to allocate authority to a level that can be considered equal to that of the House of Representatives.
Assuming our current unitary state system and presidential system of governance, we examined the various issues to consider for the composition of a regional representative Senate. Regarding the status of the Senate to function effectively in response to the House of Representatives, direct election by residents would be desirable from the perspective of democratic legitimacy, but indirect elections can also be considered to emphasize regional representativeness. Additionally, we reviewed whether to apply the recall system depending on the election method, the method of district delineation and seat allocation for the election of Senators, the distribution of substantive authority such as legislative power, the proposal of constitutional amendments, financial authority, the authority to form power institutions, the differentiation of terms to allow cross-election with House members, and the naming of the Senate with a distinct identity such as "Regional House" instead of "House of Councillors".
The establishment of such a regional representative Senate can contribute to the promotion of decentralization and the advancement of the political system, while also playing an important role in realizing the separation of powers within the National Assembly and maintaining checks and balances between central and local governments.
