독일·오스트리아 합의제 헌정체제 동학: 연방제-양원제-소연정/대연정과 조합주의적 정책협의의 관계 (The Dynamics of Consensual Constitutional Regimes in Germany and Austria: The Relationships between Federalism-Bicameralism--Minimal Winning/Grand Coalitions and Corporatist Policy Concertation)

초록

본 연구는 독일·오스트리아 합의제 헌정체제가 정책개혁 과정에서 어떻게 작동했는가를 비교분석했다. 첫째, 양국 간 수직적 정책조정 기제 유무에 따라 차이가 발생했다. 연방상원의 거부권을 내장한 독일 합의제 헌정체제의 협상시스템은 연방정부로 하여금 사회적 파트너보다는 상원의 다수당과의 협상을 통해 정책개혁을 추진토록 유도했으며, 따라서 매크로레벨 조합주의정치는 실패했다. 반면 상원의 거부권이 부재한 오스트리아 합의제 헌정체제의 연방정부는 조합주의적 정책협의를 선호했다. 둘째, 양국 모두에서 우파정당 간 혹은 좌파정당 간 블록 소연정은 조합주의정치와 충돌하여 정책개혁 중심이 정당·의회 정치로 이동했다. 반면 양국의 좌우 대연정인 경우 독일 조합주의정치는 부재했던 반해, 오스트리아 조합주의적 정책파트너십은 작동했다. 이는 양국의 수직적 조정기제의 유무에 연유한다. 분석결과의 이론적·한국적 함의는 다음과 같다. 첫째, 연방제-양원제 패턴이 연합정치 패턴보다 조합주의정치에 더 지배적인 인과적 임팩트로 작용한 변수이다. 둘째, 합의제 헌정체제의 초블록연합정치-조합주의정치 간 연동기제는 정책개혁의 ‘비난분산전략’이다. 셋째, 한국 합의제 헌정공학의 선차적 과제는 복지·노동시장 개혁정책 콘텐츠가 어떠해야 하는 아웃풋사이드보다는, 이를 견인하는 합의제 인풋사이드 동학의 요건이 무엇인가를 탐색하는 데 있다.

영어초록

The paper aims at analysing comparatively how consensual constitutional regimes in Germany and Austria have worked in the process of policy reforms. There have revealed differences deriving from the presence or absence of vertical mechanisms of policy coordination. First, the complicated bargaining systems of German consensual constitutional regime with veto power of Bundesrat have made federal government induced to reform several policies through negotiation with a majority party of Bundesrat, instead of social partners, thus macro-corporatist politics having failed to work. Contrary to German case, federal government under Austrian consensual constitutional regime without veto power of Bundesrat has preferred corporatist policy concertation. Second, in both countries the minimal winning bloc coalitions between rightist parties or leftist parties have become disincentives to corporatist politics, thereby the locus of policy reforms having shifted to parliamentary politics. Under both countries' leftist-rightist grand coalitions, German corporatist politics has not properly functioned, while Austrian corporatist policy partnership has done well, with the exception of the rightist coalition government(2000~2005). This differentiation is attributed to the presence or absence of vertical coordination mechanisms. In this context, the paper has theoretical and Korean implications. Firstly, the pattern of federalism-bicameralism has a stronger causal impact on corporatist politics, than the pattern of coalition politics. Secondly, the mechanisms linking between cross-bloc coalition politics and corporatist politics serve as 'blame dispersion strategies' of policy reforms. Lastly, the significant project for engineering Korean consensual constitutional regime has to focus preemptively on searching for the dynamics of consensual input-side pertinent to facilitating the output-side of contents of restructuring welfare regime or labor market.
