초록

사회적 약자로서의 유치인 역시 기본적 인권을 보장 받아야 한다. 이들의 인간성을 짓밟고 열등감을 자극하는 것은 또 다른 범죄를 가져오는 악순환의 시작이 됨에 비하여, 유치인을 올바르게 처우하는 것은 이들의 범죄성향을 치료하여 유치인들로 하여금 건전한 시민으로 거듭나게 하는 도덕적 힘이 될 수 있다. 경찰은 그동안 국민의 경찰에 대한 일부 왜곡된 인식을 변화시키기 위하여 많은 노력을 하여 왔으나, 심심찮게 불거져 나오는 가혹행위 등 인권침해사건들은 경찰 이미지를 더욱 좋지 않은 방향으로 몰아가곤 했다.
이러한 상황에서 경찰서 유치장을 경찰이 능동적이고 적극적으로 개선하려는 노력을 기울인다면 인권논란의 주도권을 경찰이 가져올 수 있으며, 인권친화적 경찰이라는 경찰본연의 이미지로 다시 태어날 수 있는 시금석을 마련할 수 있다는 점에서 경찰조직 차원의 보다 의미 있는 관심과 지원이 요구된다.
이곳 경찰서 유치장에서 인권 친화적 경찰로 거듭나는 발판을 마련할 수 있다면, 경찰조직의 각종 숙원사업 해결에 결정적 요소인 국민의 신뢰를 얻어 낼 수 있게 된다. 경찰서 유치장의 관리와 운영을 획기적으로 개선하는 방안에는 유치인의 인권보호는 물론이지만 경찰의 업무부담도 덜어주는 방법을 강구할 필요가 있다.
본 연구는 경찰서 유치장의 시설 및 운영개선을 위해서는 조직적체계상 보다 적합한 유치장 관리부서로의 전환이 필요하고, 유치장 관리부서는 종래의 수사부서(搜査部署)에서 비수사부서(非搜査部署)로 이관하여야 하는 바, 청문감사부서 내지 경무부서로의 관리이관을 위한 장단점을 분석한 결과, 경무부서로의 이관이 현실적이라고 판단하였다. 또한 경찰청 인권국 설치 및 미스테리 쇼퍼 등 행여 인권침해요소가 없는지를 상시 들여다 볼 수 있는 유치장 운영상의 기존 감시조직상의 구성 및 운용에 있어서도 법적·제도적 개선이 요구된다고 보았다.

Prisoners as social minorities are also objects of fundamental rights. Ignoring one's personality and fostering inferiority complex can produce another crime, moral treatment may cure criminal psychology and be a motive power to turn a prisoner to be a good highly motivated citizen.
The police had been endeavoring many efforts in order to diversify the awareness which the some about police of the people is distorted. But the human rights violations including harsh treatment, which the police stood out sometimes bought in a lump the police image to the direction which is not better.
In this situation, if the effort that the police is active and positively it improves the police station jail is concentrated on, the police can bring the leadership of the human rights dispute. And the more meaningful concern of the organization of police view and support is required in that the touchstone which can be again born into the image of the police nature that it is the human rights affinity police can be prepared. If the footstool which is reborn as the human rights friendly police from police station jail can be prepared, the confidence of the people who is the conclusive factor on every kind business of heart's desire solution of the organization of police is obtained. The inducement humanity and justice protection of human rights is on the method improving the administration of the police station jail and operation innovatively with nothing but the method in which the burden of work of the police lessens loads to be taken.
For the equipment of the police station jail and improvement of operation, the change to was needed. This research is more suitable than the systematic system look it had to transfer the jail management department to the non-investigation department from the conventional investigation department. And the improvement was required as to the organization of the existing monitoring phase of the jail in managing which it can look into the on-going basis whether possibly there was no violation of human rights element or not and operation.
