디지털 성범죄 피해자 지원 방향 (A Study on the Direction of Support for Victims of Digital Sex Crimes)

초록

그간 정부는 디지털 성범죄 근절을 위해 관련 법을 제정하고 정책을 개선하였다. 그 결과 디지털 성범죄 처벌이 강화되고 피해자 보호와 지원 방안이 확대되었다. 하지만 범죄수법이 진화되어 새로운 양상의 디지털 성범죄가 확산되고 있으며 2차 피해도 심각한 상태이다. 따라서 지금까지 변화된 정부의 ‘디지털 성범죄 근절 대책 방안’을 종합적으로 정리하고 제도적인 보완점을 살펴볼 필요가 있다. 특히 정보통신기술의 특수성으로 피해자가 느끼는 불안과 두려움은 반영구적이므로 디지털 성범죄의 피해자 보호 대책은 강화되어야 한다. 이를 위해 이 연구는 문헌 및 공식적인 통계자료 등을 인용하여 피해자 관점에서 디지털 성범죄 관련 법률 개정 내용과 현황 및 인식 자료를 점검하고 좀 더 강화된 피해자 지원 방안을 모색하였다.
이 연구의 주요결과는 다음과 같다. 첫째, 디지털 성범죄의 피해자는 삭제지원을 원하고 유포 확산을 두려워한다. 따라서 디지털 성범죄물 유포 확산 방지를 위해 유포자 처벌과 온라인 사업자 규제 모두 강화할 필요가 있음을 제안하였다. 아울러, 재판과정에서의 양형 기준은 피해자 관점에서 마련되어야 함을 강조하였다. 둘째, 디지털 성범죄와 관련해 ‘피해자에게도 책임이 있다’라는 인식과 ‘디지털 성범죄물을 단순 소지하는 정도는 괜찮다’라는 인식 수준이 높은 것으로 나타났다. 이러한 결과를 통해 디지털 성범죄는 피해 사실이 드러나지 않는 한 피해가 과소평가될 가능성이 높은 점을 시사한다. 따라서 디지털 성범죄의 2차 피해 방지를 위한 지침 마련, 피해자다움을 요구하는 왜곡된 인식개선 교육, 청소년 대상 미디어 리터러시 교육의 필요성 등을 제안하였다. 셋째, 피해자가 필요한 서비스를 받을 수 있도록 민·관이 협력하여야 하며, 삭제지원 외에도 피해자가 일상으로 복귀할 수 있도록 피해자 치유 및 회복적 지원과 상담지원이 강화되어야 함을 강조하였다. 그러기 위해서는 무엇보다 디지털 성범죄 피해자 지원기관의 전문성과 고용안정이 필요하다고 주장하였다.

영어초록

Recently, the government has improved related legislation and policies to eradicate digital sex crimes. As a result, punishment for digital sex crimes has been strengthened and measures to protect and support victims have been expanded. However, as criminal methods have evolved, a new type of digital sex crime is spreading. The secondary damage to the victim is also serious. Therefore, it is necessary to comprehensively summarize the government’s ‘measures to eradicate digital sex crimes’ that have been changed so far, and to look at institutional improvements. In particular, due to the specificity of information and communication technology, the anxiety and fear felt by the victim have semi-permanent characteristics. Therefore, measures to protect victims of digital sex crimes need to be strengthened. To this end, this study was analyzed using literature and official statistical data. Also, from the victim's point of view, revision of laws related to digital sex crimes, the current status and perception data were reviewed, and a stronger victim support plan was sought.
The results of this study are as follows. First, victims most need support for deletion of videos. There is also a high fear of spreading the spread. Therefore, the necessity of strengthening punishment for those who distribute and redistribute was proposed. In addition, a deletion order is required to prevent distribution. It was also emphasized that the sentencing standards in the trial process should be prepared from the point of view of the victim. Second, it was found that digital sex crimes had a high level of perception that ‘the victim is responsible’ and ‘simple possession of video material is allowed’. As a result, it was argued that the damage of digital sex crimes is highly likely to be underestimated. Therefore, it is necessary to prepare guidelines for preventing secondary damage from digital sex crimes. In addition, it emphasized education on improving distorted perceptions that demand victimism, and education on media literacy to promote the correct use of media. Third, public-private cooperation should be emphasized so that victims can receive the services they need. He also emphasized that in order to support the victims, not only the deletion support, but also the victim's healing and recovery support and counseling support should be strengthened so that the victims can return to their daily lives. To this end, it emphasized the need for professionalism and job security of digital sex crime victims support organizations.
