사해행위 취소채권자의 가처분과 수익자의 고유채권자의 가압류 사이의 우열관계 (The Relationship of Superiority/Inferiority between the Provisional Disposition of the Revoking Creditor for Fraudulent Act and the Provisional Seizure of the Beneficiary's Own Creditor)

초록

대상판결은 채권자가 채무자의 금전채권에 대하여 가처분결정을 받아 가처분결정이 제3채무자에게 송달되고 그 후 본안소송에서 승소하여 확정되었다면, 가처분결정의 송달 이후에 실시된 가압류 등의 보전처분 또는 그에 기한 강제집행은 가처분의 처분금지 효력에 반하는 범위 내에서는 가처분채권자에게 대항할 수 없다고 한다. 이는 채무자의 제3채무자에 대한 금전채권에 관하여 취소채권자의 가처분 효력이 발생한 이후에 수익자의 고유채권자가 가압류하더라도 취소채권자에게 대항할 수 없다고 밝힌 최초의 판결로 평가된다. 동일한 목적물에 대하여 가압류와 가처분이 경합하는 경우, 집행채권자의 법률상 지위가 양립할 수 있는 때에는 처분금지의 효력이 문제되지 않지만 양립할 수 없을 때에는 그렇지 않는다. 소유권이전등기청구권에 대한 가처분과 가압류결정은 금전채권의 보전처분과 달리 제3채무자가 채무자에게 소유권이전등기절차를 이행하는 것을 변제금지의 내용으로 하므로, 집행채권자의 법률상 지위가 양립할 수 있다. 반면에 골프회원권에 대한 가처분과 가압류결정은 누구에게 그 법률상 지위가 귀속되는지에 관한 것으로 양자의 권리가 양립할 수 없다. 따라서 대법원ﾠ2009.12.24.ﾠ선고ﾠ2008다10884ﾠ판결을 인용하여 사해행위 목적물에 대한 가처분의 처분금지 효력이 미치는 범위 내에서 가압류의 효력을 부정한 대상판결의 태도는 타당하다고 할 것이다.

영어초록

The Supreme Court 2012da116260 decision rendered on June 26, 2014 stated that if the creditor was given a decision of provisional disposition against a debtor’s monetary credit, and if the decision of provisional disposition was served to a third debtor, and thereafter if the creditor won the lawsuit on the merits which became final, a preservative disposition such as a provisional seizure performed after the decision of provisional disposition was served, or a forced execution based thereupon cannot oppose the creditor who performed a provisional disposition within the extent contrary to the disposition prohibition effect of the provisional disposition. This is evaluated as the first decision stating that even if the beneficiary's own creditor seizes a debtor’s monetary credit against a third debtor of the debtor provisionally after the provisional disposition of revoking creditor became effective, such provisional seizure cannot oppose the revoking creditor. In the event that a provisional seizure and a provisional disposition concur with regard to the same object, if the executing creditor's legal status is compatible, the effect of disposition prohibition is out of the question but it may become an issue if the status is incompatible. The decisions of provisional disposition and provisional seizure on the claim right to transfer registration of ownership consider a third debtor’s implementation of the procedures for transfer registration of ownership against a debtor as the contents of payment prohibition unlike a preservative disposition of monetary credit, thus the legal status of executing creditor is compatible. On the other hand, the decisions of provisional disposition and provisional seizure on the golf club membership are related to who is entitled to the legal status, and the rights of both parties are incompatible. Therefore, by citing the Supreme Court 2008da10884 decision rendered on Dec. 24, 2009, the attitude of the applicable decision which denied the effect of provisional seizure within the extent that the disposition prohibiting effect of provisional disposition affects the object of fraudulent act may be deemed reasonable.
