지자체 특례제도에 관한 한･일･영 비교연구: 도서특례를 중심으로 (A Comparative Study of the Special Status of the Isolated Islands Belonging to Korea, Japan, and the U.K.)

초록

본 연구는 한국･일본･영국의 도서특례제도를 비교하고, 일본과 영국의 도서특례제도에 영향을 미친 구조적, 제도적 요인을 분석하여 우리나라 도서특례제도 설계에 주는 시사점과 개선대안을 제시하는데 목적이 있다. 분석결과 첫째, 특례제도의 내용을 비교하면 우리나라는 매우 낮은 수준의 재정특례를 도입하고 있지만, 영국은 지위특례와 권한특례를, 일본은 강력한 재정특례를 부여하고 있다. 둘째, 정치행정체제의 차이(내각제와 대통령제, 중앙-지방관계)와 유사특례(대도시특례)의 존재여부가 일본과 영국에 있어서 상이한 유형의 도서특례를 가져왔다. 셋째, 우리나라는 대통령제와 중앙집권적 특성을 가지고 있지만 대통령의 국회장악력과 수평적 중앙-지방관계 변화를 고려할 때 논란의 여지가 있는 지위특례와 권한특례(영국제도)를 도입하기는 어려울 것이다. 대신 도서지역의 고립과 군사적 위협에 따른 특수행정수요, 나아가 대도시특례와의 형평성 확보 차원에서 보다 강화된 재정특례(일본제도)를 도입할 수 있을 것이다. 재정특례를 강화하기 위해 첫째, 항공(경비행장 건설과 운행), 선박 등 접근성 제고와 정체성 확보에 관한 재정지원이 필요하다. 둘째, 낙후와 고립 그리고 군사적 위협 등 도서지역의 여건을 고려하여 지역별로 차등화된 국고보조율을 적용할 필요가 있다. 셋째, 중장기적으로는 권한특례도 검토해야 한다. 일본의 도발과 북한의 침공에 노출되어 있는 울릉도와 서해5도는 재정특례의 강화만으로 지역의 발전과 주민의 생활조건을 강화하기 어렵다. 광역지자체의 권한인 교육, 교통 등을 직접 수행하도록 하되 재원은 국가가 지원하는 새로운 모델도 검토해야 할 것이다.

영어초록

This paper aims to compare exceptional support systems for the isolated islands belonging to three countries, Korea, Japan, and the U.K.; to examine the structural and institutional factors affecting these systems; and, in the Korean case, to discuss the policy implications around, and some future directions for redesigning the exceptional support system congruent with the Korean situation. Our analysis shows, firstly, that Korea operates a system that grants the islands a low level of financial support, whereas the U.K. has a system granting exceptional status and authority to the islands. Japan, too, has a system in which the islands can be given strong financial support as a special case. Secondly, we found that the differences between the political systems of the three countries (e.g., in terms of cabinet and presidential systems and the relationship between central and local government), and the existence of similar support systems granting exceptions in other areas (e.g., an Exceptional Clause in the Special Law for the Metropolitan Cities), create differences in the way these countries address their isolated islands. Thirdly, it seems that it is not easy for Korea to introduce a system granting special status to the islands, since even though the country has a centralized political system with a president, the president's control over the National Assembly is not strong, and the relationship between central and local government has changed. Nevertheless, the Korean government needs to consider introducing a system in which the isolated islands can be exceptionally supported, since the poverty and isolation they face may constitute grounds for enacting a special law covering them as a special case. As regards the exceptional support system for Korea's isolated islands, financial assistance to facilitate access to the airport and seaport should be reinforced. Secondly, a differentiated government subsidy system should be adopted, so that the poor conditions from which the islands' inhabitants suffer can be improved. Thirdly, from a long-term perspective, a system granting special authority to the islands should be examined, since they are exposed to military threats from North Korea and intermittent provocative activities by Japan, and therefore need to be safeguarded more effectively.
