프랑스법상 임차인의 용법준수의무 (Tenants Obligation to observe their user covenant in French law)

초록

프랑스민법 제1728조는 임차인이 목적물을 사용수익함에 있어 합리적 주의를 다하고 용법을 준수할 것을 요구한다. 이 조문은 임차인에게 두 가지의 부작위의무를 부과하는데 그 중 하나는 목적물을 “합리적으로” 사용할 의무, 즉 남용하지 않을 의무이고, 다른 하나는 목적물의 용법을 준수할 의무이다. 이 중 용법준수의무는 주거용 건물에서 영업을 할 수 있는지, 상사건물에서 본래 약정한 영업 이외의 영업을 할 수 있는지 하는 점을 중심으로 법리가 전개되었다. 임차인이 목적물을 용법을 벗어나 사용하지 않는다 해도 합리적으로 사용하지 않으면 이는 용법준수의무를 위반한 것으로 평가된다. 이는 특히 주택임대차와 관련하여 문제된다. 프랑스 주택임대차법이 주택이라는 특성을 고려하여 목적물을 남용하지 않을 의무를 강화하고 있기 때문이다(제7조 제1항 제b호).
프랑스법상 용법준수의무 위반에 대한 제재로서 대표적인 것은 임대인의 해지권이다. 특히 최단기간이나 임차인의 갱신요구권이 인정되는 임대차에 있어서 그 제재의 위력은 강력하다. 그런데 프랑스법상 주택임차인과 상가임차인에게는 법관이 은혜기간을 부여할 수 있어서 개별 사안에서의 충격완화가 가능하다. 또한 집합건물임차인의 의무위반에 대한 제재와 관련하여 특기할 만한 것은 집합건물의 관리단이나 다른 임차인이 임대인의 권리를 대위행사할 수 있도록 하고 있다는 것이다.

영어초록

In France it is usual for flats to be available for both residential and professional use, the latter use is not permitted where the réglement limits the user to habitation bourgeoise exclusively. This does not apply if the user is bourgeoise simple when, as is of the case, the block will house the offices of doctors, dentists, lawyers and other professional people in addition to flats in private occupation. Accoriding to the Loi Alur, housing tenants are obliged to use the demised premises reasonably, that is to say to respect the user authorised by the lease and not to cause any annoyance or inconvenience to other occupants of the building or to the neighborhood.
The business lease may prescribe a single user or it may permit any business to be carried on upon the premises. The former type is known as a bail exclusif, the latter as a bail tous commerces. Not to be confused with the former in the lease any adjoining premises for any business carried on by the lesse. Even without such a covenant on the part of a lessor, it has been held to be a breach of his covenant in favour of on lessee for quiet enjoyment to let premiese in the same building to another tenant for a competitive business. C.comm.art.145-47 says that ‘a lessee may exercise in addtion to the user permitted in his lease any use which is ancillary or complementary thereto.’A business lessee who wishes to extend or vary his user covenant may do so by resorting to a procedure wich is known as déspécialisation partielle if it relates to the addition of users wich are complementary to that permitted by his lease.
The lessor has the right to apply to the Court under C.civ.art.1741 for a lease to be determend on the grounds that the tenant has failed to comply with his obligation. The article leaves it to the discretion of the Court to decide if the matter complained of is of ‘a sufficient gravity’ to merit the determination of the lease. A lease may contain a re-entry provision on failure to observe the user covenant. Such a provision, however, takes effect only after a commandement. Failure within due time on the part of the lessee to cease his wrongs allows the lessor to issue proceedings for forfeiture.
