장애인복지법상 진술조력인 제도의 현황과 개선방안 (The Current status and Improvement of the assistance system under the Welfare of persons with Disabilities Act)

2021.1.27. 전면 개정되어 2021.1.28.일 시행된 「장애인복지법 제59조의 16, 진술조력인의 지원」은 피해장애인에 대한 진술조력인 참여와 진술조력인 선정 대상을 확대하여 기존 성폭력처벌법･아동학대처벌법상 피해자(13세 미만이거나 장애로 의사소통 곤란)에서 장애인복지법 개정으로 성폭력･아동학대범죄 외에도 모든 범죄의 피해장애인 대상으로 지원 대상이 확대되었다. 수사기관에서도 수사 시 피해자가 의사소통과 의사표현이 어려운 경우 진술조력인 선정여부를 확인하고 진술조력인을 선정할 수 있음을 고지하는 등의 절차가 의무화되었다. 그러나 지원 범위가 확대되었음에도 불구하고 진술조력인 제도가 의사소통이 불편한 범죄 피해자에게 제한되어 있어 피해자 이외에 의사소통의 어려움으로 진술조력의 도움이 필요한 경우에는 여전히 도움을 받을 수 없는 것이 현실이다. 이 점에서 이 연구는 개정된 진술조력인제도의 합리적인 운영을 위한 방안을 제시하고자 한다.
첫째, 진술조력인 선발 시 실질적으로 장애인과 관련된 경험과 지식의 전문성을 겸비한 장애인 전문 진술조력인을 선발･양성하여야 한다. 장애인은 의사표현에 있어서 일반인과 상당한 차이를 보이기에 장애인과 의사소통 시 고도의 전문성과 기술을 요한다. 따라서 진술조력인의 선발과정에서 우선적으로 장애인 전문 진술조력인 선발의 이분화된 제도적 정비가 이루어져야 한다.
둘째, 진술조력의 지원 대상자가 확대되어야 한다. 수사절차 진행과 재판과정에서 의사통이 부족한 피의자, 피고인, 참고인, 증인들의 소통을 조력함으로써 조력의 도움을 받지 못하여 오염된 진술로 억울함을 호소하는 사람들의 인권을 보호할 수 있을 것이다.
셋째, 진술조력인의 인력을 확대하여 충원하고 예산을 충분히 확보하여야 한다. 일부 지역의 경우 상근하는 진술조력인의 부재와 예산 부족으로 인하여 타 지역의 원스톱지원체제에 배치된 진술조력인을 활용하는 경우가 상당하기에 충분한 예산을 확보하고 집행하여 선발된 진술조력인들이 해바라기센터･장애인복지관기관･아동보호전문기관에 안정적으로 배치되어 근무함은 물론 향후 경찰청･검찰청･법원 등의 수사기관과 사법기관에 상근할 수 있도록 배치하여 장애인 및 의사소통이 어려운 모든 사람들이 신속하게 도움을 받을 수 있도록 실질적인 제도의 개선과 보장책을 마련하는 것이 필요하다.

영어초록

Fully revised on January 27, 2021 and enforced on January 28, 2021, 「Article 59-16 of the Act of Welfare for persons with disabilities, support of statement assistants」 expands the participation of statement assistants for victims with disabilities and the target for selection of statement assistants, the target of support has been expanded from victims under the age of 13 or having difficulty in communicating with disabilities to victims of all crimes with disabilities, in addition to sexual violence and child abuse crimes, for the existing Sexual Violence Punishment Act and Child Abuse Punishment Act. Even investigative agencies have become obligated to carry out procedures such as confirming whether an assistant is selected, and notifying that they can be selected if the victim has difficulty in communicating and expressing opinions during the investigation. However, despite the expansion of the scope of support, the assistance system is limited to crime victims who have difficulty communicating, any help cannot be currently obtained where they need help concerning statement assistance unless they are crime victims. In this regard, the study suggests a plan for the rational operation of the revised statement assistant system.
First, a professional statement assistant with practical experience and knowledge related to the disability must be selected and trained when selecting a statement assistant. Persons with disabilities show a significant difference from the general public in expressing their opinions, so a high level of expertise and skills are required when communicating with people with disabilities. Therefore, the divided institutional arrangement for the selection of specialized statement assistants for the persons with disabilities should be made first in the selection process of statement assistants.
Second, the number of recipients of support for statement assistance should be expanded. By assisting the communication of suspects, defendants, testifiers, and witnesses who lack communication skills during the course of investigation and trial, it would. protect the human rights of those who complain for injustice with distorted statements due to lack of assistance.
Third, it is necessary to expand and recruit the number of assistants and to secure a sufficient budget. In some regions, as the assistants assigned to the one-stop support system in other regions are utilized due to the absence af full-time assistants and lack of budget, it is necessary to improve the actual system and prepare guarantees to receive it. This can be executed by securing a sufficient budget for selected statement assistants, not only to be stably assigned and work full-time at welfare centers for persons with disabilities, and specialized child protection agencies, but also to work full-time at investigative and judicial agencies such as the National Police Agency, Prosecutor’s Office and court.
