초록

보조금은 행정주체가 공익목적의 달성을 위해 사인에게 제공하는 금전상의 이익으로서 급부행정의 영역에 속한다. 우리나라 정부 총지출 중 가장 큰 비중을 차지하는 분야는 사회복지 영역으로, 국고보조금의 규모와 성장 속도 또한 사회복지 영역에서 가장 크다. 이러한 측면에서 보조금이 사회복지 영역에서 갖는 의미가 더욱 증가하고 있다. 이 논문은 특히 최근 저출산과 고령화 위기가 현실화된 상황에서 사회복지 영역에서의 보조금은 다른 보조금과는 달리 접근할 필요성이 있다는 점을 염두에 두면서, 영유아 보육과 관련한 보조금 등 각종 지원체계를 검토하고, 관련 법적 쟁점에 관하여 고찰한다.
현재 우리나라의 영유아보육과 관련한 금전적 지원으로는 첫 만남 이용권, 아동수당, 부모급여, 보육료, 가정양육수당, 어린이집 운영경비 등에 대한 보조금이 있다. 첫 만남 이용권은 「저출산･고령사회기본법」에 규정되어 있고, 아동수당과 부모급여는 「아동수당법」을 근거로 하며, 보육료, 가정양육수당, 어린이집 운영경비 등에 대한 보조금은 「영유아보육법」을 근거로 한다.
영유아보육 관련 보조금에 관한 법적 쟁점으로는 최근 도입된 ‘부모급여’를 소재로 한 법적 근거의 문제, 관련 법령이 모호하고 복잡하여 법령의 정비가 시급하다는 점, 수급권자로서 아동의 보호범위 확대 및 신청시 접근성과 관련하여 사회적 약자 보호의 필요성이 크다는 점, 부정수급에 대한 제재가 중복되거나 과도하게 이루어지지 않도록 관련 법령의 정비가 필요하고, 이익형량 등에 있어 돌봄 공백의 발생과 같은 현실적으로 고려하여야 할 문제가 있다는 점 등을 검토하였다.
이에 더하여 무엇보다 개선의 방향은 영유아보육 관련 보조금이 단순히 양육을 담당하는 부모에 대한 지원이 아니라, 안정된 양육 환경 조성 등을 통해 아동의 복지와 기본적 권리를 보장함이 목적임을 고려한 법제개선과 인식개선이 함께 이루어져야 한다는 점을 강조하였다. 이 논문에서는 사회복지행정법에 관한 관심을 환기하는 이론적 고찰을 시도하였다. 사회복지 영역에서 행해지는 다양한 행정작용은 사회를 구성하는 모든 개인의 행복을 위한 것이고, 더불어 사회연대와 통합, 지속가능한 국가 발전과 미래와도 연결되어 있음을 새롭게 인식할 때다.

영어초록

A subsidy is a monetary benefit provided by an administrative entity to a beneficiary for the fulfillment of a public purpose, which falls under the scope of benefit administration. The social welfare sector accounts for the largest share of total government expenditure in Korea, and the size and growth rate of government subsidies are also the largest in the social welfare sector. In this regard, subsidies are becoming increasingly important in social welfare sector. Keeping in mind that subsidies in the field of social welfare need to be approached differently from other subsidies, this article examines various support systems such as subsidies for infant and child care, and discusses related legal issues, especially in the context of the recent declining birthrate and aging crisis.
Currently, financial support for infant and child care in Korea include the First Meeting Voucher, the Child Benefit, the Parental Benefit, the Fee for institutionalized child care service, the Home Care Benefit, and subsidies for daycare center. The First Meeting Voucher is stipulated in the Framework Act on Low Birth Rate in an Aging Society, the Child Benefit and the Parental Benefit are based on the Child Benefit Act, and the Fee for institutionalized child care service, the Home Care Benefit, and subsidies for daycare center are based on the Child Care Act.
The legal issues related to subsidies for infant and child care include the problem of the legal grounds of the recently introduced the ‘Parental Benefits’, the urgent need to revise the relevant laws and regulations due to their vagueness and complexity, the need to protect the socially vulnerable with regard to the expansion of the scope of protection of children as beneficiaries and accessibility when applying, the need to revise the relevant laws and regulations so that sanctions for fraudulent benefits are not duplicated or excessive, and the need to consider practical issues such as the occurrence of gaps in care.
In addition, the direction of improvement is that the subsidy related to infant and child care should be made by improving both the legislation and awareness of people, considering that the purpose of the subsidy is to ensure the welfare and basic rights of children by creating a stable child care environment, not just to support for parents in charge of child care. This article attempts to provide a theoretical review of social welfare administrative law. It is time to recognize that the various administrative actions carried out in the field of social welfare are not only for the well-being of all individuals in society, but are also linked to social solidarity and integration, sustainable national development and the future.
