지방자치단체 파산제도에 관한 일고찰 - 일본의 유바리시 재정파탄사례를 중심으로 - (A Study on the Financial Management System of Local Governments - Focusing on the Cases of Yubari city in Japan -)

초록

최근 우리나라는 수도권으로의 인구집중화 현상이 심화되고 있다. 고령화 및 저출산 사회라는 문제점 뿐만 아니라, 인구 역시 수도권으로 이동하고 있다. 이는 바꾸어 말하면, 수도권 이외의 지방자치단체들은 인구의 유출이라는 문제에 대한 대안을 마련해야 한다는 것이다. 왜냐하면 수도권으로의 인구유출은 지방재정을 열악하게 하는 원인이기도 하기 때문이다. 또한 지방재정이 열악해지면, 지방자치단체의 존립을 우려해야 할 상황이 발생할 가능성도 존재한다.
이러한 문제는 각 지방자치단체의 책임에만 맡길 것이 아니라, 국가 역시 지방자치단체의 재정건전화를 위해 필요한 행위를 해야 하며, 이로써 헌법상 실질적 지방자치제가 보장될 것이다. 그 방안의 하나로서 2014년에 지방자치단체 파산제도의 도입에 관한 논의가 있었다. 하지만, 실제 지방자치단체 파산제도가 도입되지는 않았으며, 수도권으로의 인구집중화로 인해 지방자치단체의 재정위기는 현재도 진행되고 있다.
본 논문은 이러한 문제점을 인식하고, 국가가 지방자치단체의 존립보장 및 활성화를 위해 어떠한 행위를 해야할지에 대한 제도론적 고찰을 논의의 대상으로 하여 살펴보기로 한다. 그 방법으로써 일본 유바리시의 사례를 중점적으로 살펴보기로 한다. 일본 유바리시에 대한 소개는 국내에도 다수 문헌에서 행해지고 있다. 유바리시와 같은 사례는 우리나라에서도 충분히 발생할 수 있기 때문에, 본 논문에서는 그 현황을 보다 자세히 살펴보는 것에 집중했다.
일반적으로 지방자치단체의 회계가 타당하지 않은 경우, 주민들이 이에 대한 문제제기를 할 수 있다. 하지만, 유바리시의 경우 주민들이 그러한 회계상황을 알기 어려운 상황에 있었다. 결국 주민자치에 의해 해결될 수 없는 부분은 국가의 관리감독이 필요하다는 것이다. 이러한 관리감독은 법치행정의 성격에 비추어 법률에 그 규정을 마련하여 행해야 한다. 이러한 법치행정이 행해지지 않는 경우, 지방자치단체에 대한 관리라는 미명 하에 국가에 의한 강도 높은 통제가 행해질 수 있기 때문이다.
유바리시의 사례로부터 얻을 수 있는 시사점은 국가에 의해 지방자치단체가 관리되는 경우, 지방자치단체의 채무감소라는 수치에 집중할 것이 아니라, 당해 지역에 거주하고 있는 주민들의 삶의 질과 행정서비스를 기준으로 채무변제기간 등을 설정해야 한다는 것이다. 이로써 주민들의 균형있는 행정서비스의 향유와 지방자치단체의 건전한 재정관리 양자를 모두 달성하게 될 것이다.

영어초록

Recently, the population concentration in the Seoul metropolitan area has intensified in Korea. Despite the emerging problems of aging and low birth rate society, the population is moving further to the Seoul metropolitan area. In other words, local governments except on the metropolitan area should consider alternatives to the issue of population outflow. Because the outflow of the population is also a cause of poor local finances. If local finances become poor, there is a possibility that local governments will have to worry about the existence of local governments.
Instead of leaving these issues to the responsibility of each local government, the state needs to act more actively to improve the financial health of local governments. This guarantees substantial local autonomy under the Constitution. As part of the plan, there was discussion about the introduction of a local government bankruptcy system in 2014. However, local government bankruptcy system has been not introduced. However, due to the centralization of the population into the metropolitan area, the financial crisis of local governments is still ongoing.
Recognizing these problems, this paper will examine the institutional consideration of what the state should do to ensure and revitalize the existence of local governments. In that way, we will focus on the case of Yubari City in Japan. An introduction to the city of Yubari is also conducted in many Korean literature. This paper focused on taking a closer look at the current situation, as examples such as Yubari city’s case can occur in Korea as well.
In general, if the accounting of local governments is not reasonable, residents may raise questions about it. In the case of Yubari City, it was difficult for residents to understand such accounting conditions. In the end, we can see that the part that cannot be solved by the autonomy of the residents needs to be managed by the state. Such supervision can be done by administration of the rule of law, such regulations can be prepared and implemented in the law. If such administration of the rule of law is not carried out, intensive control by the state may be carried out under the guise of management of local governments.
What should be thought of from the case of Yubari City is that when management is carried out by the state, the debt repayment period should be set based on the quality of life and administrative services of local residents, not focusing on the figure of debt reduction. This will achieve both the enjoyment of balanced administrative services and the financial management of local governments.
