신흥 이민 유입국 중국의 이민정책에 대한 고찰 - 중국 유입 외국인을 중심으로 (A Study on the Immigration Policy of the New Immigration Country China - Focusing on the inflow of foreigners into China)

중국 제7차 인구센서스 결과에 따르면 2020년 11월 기준 중국 정착 외국인의 규모는 845,697명으로 집계되었는데, 이는 2010년보다 251,865명 증가한 수치이다. 외국인 유입 규모 확대, 체류목적 다양화, 장기체류자 비율 증가 등으로 인해 중국 국내에서도 이민이 새로운 이슈로 부상되고 있으며, 베이징 왕징코리아타운·광둥 아프리카거리·이우 중동거리를 비롯한 다양한 외국인 밀집지역이 형성되었다. 이렇듯 중국은 기존의 이민 송출국에서 점차 이민 송출과 유입이 병행되는 국가로 전환되고 있다. 중국은 『국적법』, 『출입국관리법』, 『귀교교권권익보호법』, 『여권법』, 『재중영구거류외국인혜택관련방법』 등을 제정하여 이민정책의 법적 기반을 마련하였다. 또한 중국은 2016년에 국제이주기구에 가입해 165번째 회원국이 되었으며, 2018년에는 국가이민관리국을 신설해 보다 정교하고 체계적인 이민정책을 추진하기 시작하였다. 이러한 배경 하에 이 연구는 중국 국내 유입 외국인을 중심으로 그들의 실태 및 외국인 밀집지역을 살펴보고, 중국 이민정책의 발전과정을 단계별로 나누어 그 특징을 검토하였으며, 이민정책의 문제점을 세부적으로 논의함으로써 향후 바람직한 방향을 제시하였다. 연구결과 중국의 이민정책은 기존의 제한, 통제에서 점차 체계화, 규범화로 발전하고 있으나 이민 개념 부재, 기초조사 부진, 이민 유입 제한, 사회통합 미흡 등 문제점을 내포하고 있다. 따라서 향후 중국의 이민정책은 “이민” 개념을 도입해 체계적인 이민법 체계를 구축해야 할 것이며, 이민 유입 요건을 완화해 “인재비자”, “그린카드” 등 장기 체류자격의 실효성을 향상시켜야 할 것이다. 아울러 이주민의 사회보장제도를 개선하고, 그들의 중국사회 안정적 정착을 위한 사회통합정책 마련이 절실하다.

영어초록

According to the results of China’s seventh census, as of November 2020, 845,697 foreigners lived in 31 provinces in China, an increase of 251,865 over 2010. With the continuous influx of foreigners, many areas inhabited by foreigners have been formed in China, such as Wangjing Korean city in Beijing, Guangdong Africa street, Yiwu Middle East Street and so on. At present, China is transforming from an immigrant exporting country to an immigrant importing country. In 2016, China officially became the 165th member state of the international organization for migration. In 2018, China established the National Immigration administration and took this opportunity to gradually build a systematic immigration policy system. Taking immigrants settled in China as the research object, this paper analyzes the current situation of China’s immigration, expounds the development process and characteristics of China’s immigration policy, and provides some suggestions for the development direction through in-depth analysis of the problems existing in China’s immigration policy.
The results show that China’s immigration policy has made great progress from strict control to reducing the restrictions on foreigners' stay, vigorously introducing foreign experts, developing the permanent residence system and establishing the National Immigration Administration. But there are still many problems. For example, the lack of the concept of immigration, the harsh access policy, the initial social security policy and the lack of social integration. As China becomes a country of immigration, the author believes that in the future, China’s immigration policy should introduce the concept of “immigration” as soon as possible and establish a standardized and systematic immigration legal system. Relax the access policy and improve the operability of “talent visa” and “China green card”. At the same time, China should provide living services and social security for legal immigrants and formulate social integration policies for their integration into Chinese society.
