감사원 직무감찰 제도의 현황과 기능 (The Current Status and Functions of the Duty Inspection of the Board of Audit and inspection)

초록

감사원은 감사와 감찰이라는 헌법상의 권한을 매개로 강력한 부패통제 기능을 수행한다. 현대 감사의 특징은 합법성에 국한되지 않는다. 행정의 효율성, 효과성, 경제성 및 능률성에도 감사범위가 확대되고 있다. 그 때문에 감사기능은 소극적․통제적 수준에 머물지 않고 예방적이고 적극적․지원적 역할까지 수행한다. 감사원의 직무감찰 기능은 다른 최고감사기구와는 차별화된 특성으로 대통령 직속기관 차원에서는 내부통제수단으로, 그리고 직무상 독립기관으로서는 행정 각부에 대한 외부통제수단으로의 성격을 모두 지닌다.
감사원의 조직상․직무상의 독립성이 확보되고, 직무감찰범위를 확대하는 등의 규범적․제도적 장치가 보완된다면, 확대된 직무감찰권한을 매개로 한 부패통제의 컨트롤타워로서 헌법상의 지위를 새로이 발견할 수 있을 것이다. 헌법은 감사원으로 하여금 부패통제를 위한 중추적 역할을 수행하도록 하는 헌법상의 지위를 부여하고 있다. 부패통제영역에서 감사원의 헌법상의 지위를 새로이 발견하는 것은 매우 의미 있는 일이다. 다만 감사원이 부패통제를 위한 컨트롤타워로서 헌법상의 지위를 확립하기 위해서는 직무감찰 대상의 확대 가능성이 전제되어야 한다. 감사원의 직무감찰권한은 조직상의 한계, 직무상의 한계, 정치적 한계 등에 의한 제한을 받고 있다. 감사원이 부패통제를 위한 컨트롤타워로서 헌법상의 지위를 확고히 자리매김하기 위해서는 조직상․직무상․정치상의 한계가 극복되어야 한다. 적어도 국가에 대한 회계검사권한의 범위에 상응하게 직무감찰권한을 확대할 필요가 있고, 이 확대된 직무감찰권한은 강력한 부패통제효과를 가져올 수 있다.

영어초록

The Board of Audit and Inspection performs powerful functions of controlling corruption, that is, a constitutional right of auditing and inspection. Characteristic features of modern auditing are not limited to legitimacy alone. The scope of auditing is so widened as to cover efficiency, effectiveness, economical efficiency and productivity. Therefore, the function of auditing is not limited to a negative and controllable level but plays preventative, positive and supportive roles as well. When independency on the level of organization and duty has been secured, and normative and institutional devices such as expansion of the scope of duties have been complemented, constitutional positions at the control tower of preventing corruption based on duty inspection authority empowered by the constitution could newly be identified. The duty inspection function, the one differentiated from other supreme inspection organizations, embraces all the functions of internal controlling means on the level of an exclusively presidential agency, and of external means of controlling administrative ministries as an independent agency in terms of administrative duties.
The duty inspection authority of the Board of Auditing and Inspection is a highly efficient means for controlling corruption. Duty inspection includes combined personnel inspection and administrative duty inspection. The auditing inspection authority empowered by the constitution is an assured supportive force for the performance of duty inspection. The constitution empowers the Board of Auditing and Inspection with a constitutional position that enables the agency to play roles central to the control of corruption. It is highly significant to newly identify a constitutional position of the Board of Auditing and Inspection in the area of controlling corruption. Notwithstanding, if the Board of Auditing and Inspection is to establish its constitutional position as the control tower for controlling corruption, feasibility of enlarging the object of duty inspection should be assumed. The duty inspection authority of the Board of Auditing and Inspection is restricted by organizational, political and other limitations. If the Board of Auditing and Inspection is to establish its constitutional position, limitations from the perspective of organization, duty and politics should be overcome. The authority of duty inspection commensurate with the scope of the authority of examining accounts needs to be expanded, and the expanded authority of duty inspection could bring about a strong effect of controlling corruption.
