초록

충분한 준비 없이 개원한 법학전문대학원(이하 ‘로스쿨’이라 함)이 출범 10주년을 맞이하였다. 개원 당시 법조계와 교육계 모두의 우려 섞인 목소리가 터져 나왔으나, 법학전문대학원은 지난 10년간 사법시험과 기존 법과대학의 폐해를 극복하고 적지 않은 성과를 보여 왔다. 이 과정에서 1기 입학생부터 7기 입학생들이 제7회의 변호사시험을 치루었다.
변호사시험은 로스쿨 교육의 내용과 깊이, 교육방법 등 다방면에 영향을 미쳐 결국 로스쿨의 내실화와 정상화를 결정짓는다. 그러나 7회에 걸쳐 시행된 변호사시험이 좋은 전문가가 될 수 있는 법조인을 양성하는 교육에 기여하는가에 대해서는 의문을 가지지 않을 수 없다. 변호사시험 합격과 이후 취업경쟁은 로스쿨 재학생들 간에 감정적이고 소모적이고 기회주의적 경쟁주의의 팽배를 초래하는 원인으로 지목되고 있기 때문이다.
현행 변호사시험 문제의 문제점을 구체적으로 살펴보면, 지나치게 광범위한 시험범위, 복잡하지만 차별성이 사라진 문제 유형, 판례 위주의 단순 암기형 문제, 인위적이고 부자연스러운 통합형 문제, 지나치게 긴 지문과 쪼개진 소문, 평가 의미를 상실한 전문적 법률분야 과목의 시험 등을 꼽을 수 있다.
선진적 변호사시험이 선진적 로스쿨을 이끌어 낸다는 점에서 교육을 통한 법조인의 양성이라는 로스쿨의 취지와 목표를 실현하기 위해서는 현행 변호사시험의 개선이 불가피하다. 우선 변호사시험 문제는 선택형, 사례형, 기록형으로 구분된 시험유형별 고유의 기능과 취지를 회복해야 하며, 다음으로 속독속기 경쟁이 되지 않도록 문항 수를 축소하고 지문의 단순화가 이뤄져야 한다. 그리고 단순 암기위주로 출제되는 판례 문제를 축소하고 과목별 판례의 출제 범위를 한정하여 사법시험의 폐해를 극복해야 한다. 또한 통합형 출제의 의무감이나 강박감으로 인한 부자연스러운 통합형 문제는 지양하여야 한다. 아울러 기록형 문제의 출제 유형을 제한하고 법률실무능력을 측정할 수 있도록 실질적인 기록형 문제가 출제되도록 해야 한다. 마지막으로 평가의 의미가 퇴색된 선택법 과목은 폐지 후 과목 이수 체제로 전환할 필요가 있다.
변호사시험은 결코 과거 사법시험처럼 떨어뜨리는 시험이 아며, 통상적인 교육과정을 이수하였는지를 검증하고 그 결과가 로스쿨의 법학교육에 충실히 환류될 수 있어야 한다. 이때 가장 중요한 점은 변호사시험이 ‘변시낭인’이라는 새로운 고시낭인을 양산하지 않아야 하며 법학교육을 다시 황폐화하도록 만들어서는 안 된다는 것이다. 변호사시험 합격률이 로스쿨 교육의 모든 면을 집어삼키는 블랙홀이 되는 것을 방치해서는 안 된다.

The law school, which was opened without sufficient preparation, celebrated its 10th anniversary. At the time of the opening of the school, the voices of both the lawyers and the education professions burst out, but the law school has achieved remarkable achievements over the past decade.
Bar examinations affect many aspects of law school education, such as content, depth, and education methods, which ultimately determine the normalization and strengthening of law school. However, I have to wonder if the seven-time Bar examinations contribute to the training of law students who can become good experts. This is because the passing of the bar exam and the subsequent competition for employment are pointed out as causes of emotional, exhaustive and opportunistic competition among students.
The problem of the current bar examination problem can be seen in detail as follows : an overly broad range, problem type with no differentiation, precedent-oriented problem, artificial and unnatural integrated problem, overly long fingerprint and cleaved problem, And examinations of specialized legal field subjects.
Because the advanced bar examination leads to the advanced law school, it is inevitable to improve the current bar examination in order to realize the purpose and goal of law school education through education. First, the bar exam questions should be restored to the function and purpose specific to each type of test. Next, the number of questions should be reduced and fingerprints should be simplified. In addition, it is necessary to narrow down the precedent cases focused on simple memorization and limiting the scope of the cases. In addition, the unnecessary integration problems due to the sense of responsibility of the integration type should be avoided. In addition, it is necessary to limit the types of questions of practical problems and to make practical problems. Finally, it is necessary to switch to a form in which the meaning of the evaluation is faded and the elective course is taken after the abolition.
Bar examination is never a test to drop like past bar examination. It should be verified that the examinee has completed the normal course and the result should be faithfully returned to the legal education of the law school. The most important point is that the bar exam should not produce a new “bar exam retakers” and should not make law education devastate again. It should not be neglected that the passing rate of the bar exam becomes a black hole that swallows all aspects of law school education.
