초록

한국의 주민자치회는 일본의 자치회, 정내회 등의 명칭을 가진 자치회와 더불어 공민관이라는 시설적 측면을 강조한 제도로 알려져 있지만, 중요한 것은 이러한 제도에 관한 개별 규정들에 관한 검토이다. 결론적으로 우리의 주민자치회는 일본의 제도와 유사한 측면도 많으나 일본 지방자치법상의 여러 제도를 하나의 제도로 통합하였고 우리의 제도 목적 및 실정을 반영하기 위하여 독창적이고도 특이한 규범적 구성을 보이고 있다.
따라서 일본의 유사 제도와는 다른 복합적인 성격과 업무 구성을 보이고 있어 그 성격과 방향성에 대한 신중한 검토가 필요한 것으로 보인다. 결론적으로 말하자면 정부가 주민자치회를 설치하고 주민자치회에게 맡기고자 하는 것 또는 얻고자 하는 것이 무엇인지 하는 것에 대한 논의는 별론으로 하더라도 당해 제도에 대한 법규범적 정당성을 고찰하는 것은 지금까지 논의되고 있는 지방자치에 있어서의 주민자치, 주민참여, 주민의 역할 강화 등의 방향성을 제시하는 중요한 소재가 될 것으로 생각된다.
이와 같은 관점에서 본 논문에서는, 주민자치회는 무엇을 목적으로 하는지, 그 목적 또는 취지 달성을 위하여 주민참여를 구현하는 개별 조치 사항의 함의는 무엇인지 등을 명확히 하기 위한 분석의 소재로서, 주민자치회의 시범실시를 위하여 제정ㆍ운영되고 있는 2020년의 「주민자치회 시범실시 및 설치․운영에 관한 조례 개정(안)」를 분석의 주된 소재로 한다. 아울러 이를 바탕으로 제정ㆍ운영되고 있는 현행 「세종특별자치시 주민자치회 시범실시 및 설치·운영에 관한 조례」의 근거·목적을 정리한 후, 주민자치회는 어떠한 성격의 조직인지를 그 의의·설치·업무·조직·운영 등에 관한 개별 규정을 검토하고 해석함으로써 그 함의에 관하여 고찰하고자 한다. 또한, 고찰의 방법으로서는 현행 표준조례 및 세종시 조례의 법규범적 검토를 통하여 현행 주민자치회에 내재하고 있는 의의와 그 한계점 또는 모순을 지적하고자 한다.
그리고 주민자치회를 구성하는 핵심적인 인적 요소인 ‘위원’에 관하여도 그 의의·선정·자격·의무 등에 관한 개별 규정을 검토함으로써 그 성격을 명확히 하여 주민자치회와 위원을 중심으로 총괄적으로 평가함으로써 현행 주민자치회의 모순을 지적하고 향후 방향성에 대한 약간의 사견을 제시하는 것으로 논문의 결론을 대신하고자 한다.
이와 더불어 본 논문에서 분석 및 논증한 표준조례와 세종시 조례가 제시하고 있는 ‘주민자치회’의 복합적이고 다양한 성격은 한국의 독창적인 제도 설계라는 점에서 긍정적으로도 평가할 수도 있다. 하지만 문제는 이를 실행하기 위한 구체적 규정이 결여되어 있음을 지적하고 이를 보완하기 위한 입법적 조치가 필수적이라는 것을 강조해 두고자 한다.

영어초록

The Korean Residents' Association is known as a system that emphasizes the facilities of self-governing associations and community centers under the names of Japanese self-governing associations and neighborhood associations, but it is important to review individual regulations on these systems.In conclusion, the Korean Residents' Association has many similar aspects to the Japanese system, but it shows original and unique normative composition to reflect Korea's actual situation and purpose by integrating various systems under the Japanese Local Autonomy Law into one system.Therefore, it shows a complex character and work structure different from Japan's similar system, so careful consideration of its character and direction is needed.In conclusion, apart from discussions on the government's intention to establish and entrust residents' self-governing associations or what it wants to obtain, examining legal legitimacy of the system is considered an important subject.
From this point of view, this paper aims to clarify what is the purpose of residents' associations, and what is the implication of individual measures to realize resident participation in order to achieve that purpose or purpose. As a place for analysis, it is established and operated based on the 2022 ``Revision of the ordinance on the implementation, establishment and operation of the model of the residents' self-governing association (draft)'', which was established and operated for the trial implementation of the residents' association. After analyzing the basis and purpose of the current “Sejong Special Self-Governing City Residents Association Model Implementation, Establishment, and Operation Ordinances,”' the nature of the organization of the Residents' Association will be examined, and the current method of interpretation and consideration will be Through the legal normative examination of the standard ordinance and the ordinance of Sejong City, I would like to point out the significance and limitations or contradictions inherent in the current residents' association. In addition, with regard to the ``committee members'', who are the core human elements that make up the residents' self-governing association, we will clarify their characteristics by examining individual regulations regarding their significance, selection, qualifications, duties, etc. I would like to point out the contradictions of the current Residents' Association through a comprehensive evaluation centering on the committee members, and present some of my personal opinions on the future direction of the association as a substitute for the conclusion of the paper.
In addition, I would like to point out the lack of specific regulations to implement the complex and diverse nature of the "resident self-governing association" presented by the standard and Sejong City ordinances in this paper, and emphasize that legislative measures are essential. However, I would like to clarify that this paper does not provide details of legislative measures that need to be improved in the future.
