초록

2022년 2월 24일 푸틴 러시아 대통령의 특별 군사작전이라는 이름의 러시아의우크라이나 침공은 냉전 종식 이후 전개되어온 자유주의 국제질서의 근본을 무너트리는 사건이지만 이 사건은 하루아침에 발생한 우연한 사건이 아닌 이전의 푸틴 치하의 러시아의 일련의 행동과 연속성을 띠고 있다. 2008년의 조지아 침공, 2014년의 크림반도 병합 등 과거 구소련의 영향권 내에 있었던 국가들에 대한 러시아의 지배를 강화하려는 푸틴 정권의 의도가 표출된 사건이라는 공통점이 있기때문이다. 푸틴 러시아 대통령은 과거 제정러시아와 소련의 영광을 오늘에 재현하려는 야심을 갖고 있으며 이는 그의 왜곡된 역사 인식과 연결되어 있다.
특히 주목을 요하는 부분은 푸틴은 이와 같은 러시아의 일련의 행위가 국제법적 정당성을 갖춘 행위였다는 것을 강조해 왔다는 점이다. 국제법을 원용하며 서방 자유주의 국가들을 비난하고 러시아의 행위를 정당화하는 것은 푸틴의 계속적인 행동양식이었다. 그러나 이런 러시아의 국제법 원용은 사안을구체적으로 따져봤을 때 푸틴의 왜곡된 역사관과 마찬가지로 국제법에 대한억지 해석을 통한 국제법의 오용과 왜곡 외 다름 아니다.
2022년 2월 24일 시작된 러시아의 불법적인 우크라이나 침공을 국제법적으로 정당화하기 위해 러시아는 자결권, 자위권, 그리고 인도적 개입을 원용하였다. 그러나 본 논문은 이와 같은 러시아의 국제법 원용은 전혀 근거가 없고타당하지 않다는 점을 지적하고 있다. 러시아는 자결권, 자위권, 인도적 개입등 현대국제법의 핵심규범을 원용하며 러시아의 우크라이나에서의 군사행동을정당화하고 있지만, 이는 전혀 타당하지 않다. 구체적으로 각각의 관련 국제규범 즉, 자결권, 자위권, 인도적 개입이 러시아의 우크라이나에서의 군사행동을정당화시켜줄 수 없음을 본 논문은 지적하고 있다. 오히려 러시아의 군사행동은 침략전쟁 외에 다름 아니며, 국제법의 핵심규범인 주권존중원칙과 무력사용금지원칙을 정면으로 위반한 사례이다.
러시아의 불법적인 우크라이나 침공으로 인해 국제법의 권위가 추락하고국제법이 존중되는 국제공동체 질서가 붕괴되었다는 우려가 높아지고 있는 것이 사실이지만, 본 논문은 그런 비관주의 또한 부정확하다고 지적하고 있다.
이 사건이 국제공동체에 엄청난 충격을 주고 있는 것은 사실이지만 러시아의침략전쟁에 대한 국제공동체 구성원들의 격렬한 비난과 강도 높은 제재는 여전히 국제규범이 작동하고 있는 국제공동체의 모습을 역설적으로 보여주고 있기 때문이다. 푸틴 러시아의 국제법에 대한 왜곡과 오용이 뚜렷한 ‘선례’로서남을 것이며 러시아처럼 국제법 규범을 왜곡하는 국가는 국제공동체가 힘을합쳐 용납하지 않고 응징하겠다는 선례를 만들고 있기 때문이다.
국가들은 국제공동체의 근본규범을 의식하기 마련이고 자신들의 행위를 정당화하기 위해 국제법의 근거를 계속 찾으려고 노력할 수밖에 없다. 이것 자체가 국제규범 체계에 부착된 가치의 중요성을 역설적으로 말해주는 것이며그런 가치의 원용은 결국 행위의 정당성 여부를 국제공동체에 여과 없이 드러낸다. 세계정부가 존재하지 않고 국제적 제재가 완벽할 수 없더라도 어떤 국가가 국제법을 위반하고 있는지는 국제공동체의 대부분 구성원이 판별하고 있다. 러시아의 우크라이나에 대한 침공에 대한 다수 국가의 연대적 태도가 이를 증명하고 있다.

영어초록

Russia’s invasion of Ukraine on February 24, 2022, which it has called a “special military operation,” is said to have destroyed the very foundations of the liberal international order that has developed since the end of the Cold War. However, it was simply a continuation of a series of previous actions committed by Russia, such as its invasion of Georgia in 2008 and annexation of Crimea in 2014. President Vladimir Putin’s suspected intention to strengthen Russia’s control over countries that were once under the sphere of influence of the former Soviet Union during the Cold War period has been reconfirmed by this latest invasion. Putin has revealed his distorted perception of Russian history through his conspicuous ambition to recreate the glory of imperial Russia and the Soviet Union.
Particularly noteworthy is that Putin has repeatedly emphasized that such Russian actions in its near abroad have been in accordance with international law. It has been Putin's continuing mode of conduct and speech to denounce Western liberal states and justify Russia’s actions by referring to their basis in international law. However, when considering the relevant issues in detail, Russia’s purported use of international law in these instances is nothing more than a misuse and distortion of the true norms of international law.
Russia invoked the right of self-determination, the right of self-defense, and humanitarian intervention to justify its invasion of Ukraine. However, this paper points out that Putin’s invocation of these norms of international law is completely groundless and unacceptable. On the contrary, Russia’s military action in Ukraine is merely an illegal invasion and represents a blatant violation of the fundamental norms of international law, such as the principle of respect for state sovereignty and the prohibition of the use of force. Russia’s illegal invasion of Ukraine has greatly damaged the reputation of international law by disrupting the normative order of the international community t hrough w hich i nternational law gains i ts r espect a nd authority. Excessive pessimism, however, is also unwarranted. The invasion has obviously had a negative impact on the international community, yet the fierce condemnations of Russia’s illegal aggression by members of the international community, followed by the tough sanctions they have placed on Russia, paradoxically also show that there is still a strong role for international law in the current world order. Russia's misuse and distortion of international law under Putin’s regime will remain a clear “precedent,” and the members of the international community will continue to work towards setting countervailing precedents which show that the illegal actions of delinquent countries like Russia will never be tolerated. Countries are naturally bound to be aware of the fundamental norms of the international community and have no choice but to continue to seek international legal grounds to justify their actions. This gives testimony to the importance of values attached to the international normative system. The invocation of such values by states eventually reveals to the international community whether their acts are justified or not. Even if a unified world government does not exist and the application of international sanctions may not be always perfect, members of the international community can nevertheless monitor countries that violate international law. The solidarity shown by many countries as a result of Russia’s invasion of Ukraine proves this to a large extent.
