초록

개성공단은 남북경제공동체를 완성하기 위한 디딤돌로서, 남북경협의 시금석으로 상징된다. 그러나 그 정상화의 과정은 순탄하지 않다는 점은 2013년의 가동중단 사태에서 알 수 있다. 이로부터 공단가동의 안정성을 확보하기 위한 노력이 경주되고 있으며, 이를 구체화는 법제도화 방안이 중요하게 다루어지고 있다. 아울러 일찍부터 추진해왔던 공단의 국제화방안도 보다 현실적인 체제를 갖추어 나가야 할 과제를 안고 있다.
북한은 자주, 평화, 친선이라는 대외정책의 이념과 원칙을 개성공단에도 적용한다고 볼 수 있다. 특히 경제부문의 개방자세는 남북관계의 진전과 서방에 대한 남북관계의 특수한 관계에 관하여 긍정적 인식을 유도하고 있다. 따라서 개성공단에 대한 법제지원 강화는 남북관계 뿐만 아니라 국제사회에서의 개성공단에 대한 인식도를 제고하고, 남북의 특수한 법제도적 특성을 이해시키는 데에 주력할 필요가 있다.
개성공단의 법제 인프라는 남북 통합법제의 실험장, 북한의 경제개혁법제에 대한 선례 규범으로서의 기능과 역할을 한다는 큰 의미를 부여할 수 있다. 개성공단 사업의 성공은 개성공단식의 경제특구개발이 다른 북한지역으로 확대되고, 이를 뒷받침하는 법제도에도 그대로 이식된다는 점에서 공단 법제인프라 구축에 중요한 요인이다. 이와 함께 개성공단의 국제화 노력은 또 하나의 도전과제라 할 수 있다. 개성공단의 국제경쟁력의 강화는 공단발전을 위해 필요하다. 이를 위해서는 북한의 법제도적 개선에 대한 인식이 전환되고 보다 적극적인 개방의 자세가 요청된다. 좀 더 구체적으로는 신변안전보장, 투자자산 보호, 3통(통행, 통신, 통관) 문제의 해결, 상사분쟁해결 구체화, 국제제재의 해제 등의 제도적 개선이 포함된다.

영어초록

‘Gaeseong Industrial Complex’(GIC) is considered as the symbol of a touchstone economic cooperation and a stepping stone to the standards for completing the North-South economic community. However, it can be seen from the shutdown of the 2013 crisis that the process of its normalization is not smooth. And from this, it drew out an effort to ensure the stability of the complexes movable race, embodied scheme to institute for GIC improvements. In addition, it faced a more realistic system equipped to get out of the challenges of globalization plans.
We can see that the change is applied to the surface of the ideas and principles of the Gaeseong Industrial Complex in North Korea's foreign policy. Especially, the open position in the economic sector of Inter-Korean relations standpoint, as well as progress being help to lead to positive recognition of the special legal relationship of inter-Korean relations for the Western world. In legislation to strengthen the support system for the GIC is used to understand the need to focus on Inter-Korean relationship as a special system of law and institutional characteristics of the perception of the GIC in North-South relations, as well as the international community to improve it.
We can give a great sense the legal infrastructure of the GIC is be an experimental space of the legal integration of the two Koreas, a precedent norms for economic reform in North Korea in legal function and role. Legal infrastructure of GIC is very important, because the process of the GIC’s business is successfully expanded to other special economic zones in North Korea and extended the transplant has to the legal system to other North Korea such as Gaeseong’s way. Moreover, it can also challenge the globalization efforts of Gaeseong. Development of corporation of the GIC needed to strengthen the international competitiveness of the GIC. For this conversion is requested to improve the awareness of the legal aspects and the position of the more aggressive opening of North Korea. And more improvements are included, such as solving the institutional guarantee of personal safety; protect investments, 3 main problems (passage, communication, and customs problem), and materialization of solving commercial disputes, international sanctions off, specifically.
