인슈어테크와 보험업 허가주의에 관한 고찰- 2019년 EU 보험연금감독청 보고서를 중심으로 - (A Study on the Insurtech and Insurance Business License - Focusing on the 2019 EIOPA Report -)

초록

인슈어테크(Insurtech) 확산과 더불어, 이른바 빅테크(Big Tech) 같은 IT 기반 플랫폼이나 소규모 스타트업의 보험시장 진입 활성화가 예상된다. 이 경우 보험서비스와 유사한 사업모델에 대한 허가 필요여부 등 기존의 진입규제 적용이 문제되고, 산업혁신과 거래질서·소비자보호 간 균형이 쟁점이 될 수 있다. 4차 산업혁명의 경제현상에 법제도가 따라가지 못하는 규범지체 현상도 빈발할 수 있는데, 본 연구에서는 인슈어테크에 대한 EU의 제도적 고민이 담긴 2019년 보험연금감독청 보고서를 중심으로 우리 제도상의 규제 방향성을 모색해 보았다. EU 조차도 새로운 인슈어테크 환경에서 규제 혼란을 겪고 있는 것으로 보이며, 해당 보고서 역시 세밀한 제도방안을 제시하고 있지는 않다. 다만, 최소한의 전제로 견지하는 것은 바로 동일행위 동일규제 원칙과 비례원칙이다. 이를 바탕으로 검토하면, 첫째, 새로운 인슈어테크 모델의 보험업 허가대상 여부에 모호한 점이 있더라도, 공정경쟁의 장을 저해하는 규제차익을 용인해서는 안 된다. 즉, 동일기능 동일규제 원칙에 비추어 위험보장기능을 수행하고 다수 소비자에게 영향을 미친다면 보험규제 대상으로 포함해야 한다. 둘째, 일단 규제영역에는 포함시키되 위험기반 비례원칙을 반영한 유연한 제도적 대처가 필요하다. 새로운 IT기술과 제도 간 융합의 역동성을 고려하고, 사회적 효용과 위험성 간의 비교형량을 통한 정교한 감독대응이 중요한 것이다. 이러한 진입규제상 비례원칙은 예를 들어 허가요건 완화나 예외인정, 자본금 조정도 들 수 있는데, 최근에 국내에 도입된 규제샌드박스나 소액단기보험업제도 등의 활용도 가능하다. 위와 같은 기본원칙 하에 향후 출현가능한 다양한 사업모델에 대한 각론상의 검토가 지속되어야 할 것이다.

영어초록

Along with the spread of Insurtech, IT-based platforms such as so-called Big Tech or small start-ups are expected to enter the insurance market in the future. In this case, the application of existing entry regulations such as whether a license is required for a business model similar to insurance services is a problem and the balance between industrial innovation and consumer protection may become an issue. In the era of the 4th industrial revolution, there are frequent delays in norms where the legal system cannot keep up with economic phenomena. In this paper, we explored the implications of the system of South Korea, focusing on the 2019 EIOPA report, which contains the institutional concerns of the EU on InsurTech. Even the EU seems to be still experiencing regulatory confusion in the new insurtech environment, but the minimum premise is the application of the principle of same regulation and proportionality. Based on this review, first, even if there are ambiguities in whether or not the entry regulation of the new type of insurtech model is applied, regulatory arbitrage that hinders the fair competition should not be tolerated. In other words, in light of the principle of same regulation for the same function, if it ultimately performs the risk insurance function and affects a large number of consumers, it should be included in the subject of regulation. Second, although it is included in the regulatory domain, a flexible institutional response is needed that reflects the risk-based proportionality principle. It is important to consider the dynamism of new IT technology convergence into the system, and to take a sophisticated supervisory response based on the comparison between social utility and risk. The principle of proportionality in entry regulation includes, for example, relaxation of license requirements, permit of temporary exceptions, and adjustment of capital requirement. Under the above basic principles, various business models that may emerge in the future should be reviewed in individual cases. For timely legal and institutional analysis of various business models in the future, open communication with the market should be maintained.
