초록

TPP 협정은 총 30개의 장으로 구성되어 있으며, 이 중 환경챕터는 제20장에 속해 있다. TPP는 가장 발전된 규범을 지향하는바, 기존 FTA에 있던 조항이 보다 구체화 혹은 개선되 고, 진일보한 새로운 조항이 추가되는 경우를 쉽게 찾아볼 수 있는데 그중 환경챕터가 그러 한 예라고 할 수 있다. TPP 환경챕터는 높은 수준의 환경보호 내용을 담고 있으며 동시에 신(新)환경이슈로서 선박으로부터 해양환경 오염예방, 침입외래 생물종의 통제, 야생동물의 불법밀매, 불법 벌목, 불법 어업 방지 및 해양생태계 보존, 오존층 보호 와 온실가스 배출량 감소를 통한 기후변화 문제까지 독려하고 있다. 높은 수준의 FTA 환경챕터를 갖고 있는 한국은 향후 환경협상에서 의무가 담보되는 강행 성 있는 규정의 삽입과 녹색신기술의 수출이 가능하도록 협상을 이끌어야 할 것이다. 이를 위해 가장 발전된 규범형태인 TPP환경챕터와 한국이 기존에 맺은 FTA 환경협정의 내용을 비교분석하여 정책적 시사점을 도출하고 적절한 대응방안을 찾는 작업은 의미있는 일이라하겠다. 특히 한국이 기체결한 FTA중 가장 높은 수준의 환경챕터를 담고 있는 한-미FTA와 개도국의 입장에서 다소 소극적인 환경챕터를 담고 있는 한-중FTA를 비교분석해보는 것은 향후 성공적인 환경관련 협상을 이끄는데 큰 도움이 될 것으로 본다. 세 규정의 비교분석 후 한국에게 유리한 환경챕터 구성을 위한 정책적 시사점과 대응방안을 살펴보면 다음과 같다. 첫째, 참여국들은 우선 환경관련 규정을 별도의 장(chapter)으로 구성할 것인지, 협력의 장 또는 전문에 선언적인 형태로 규정할 것인지를 정해야 하는데, 우 리 입장에서는 높은 수준의 환경보호기준과 녹색환경기술 수출을 위해 별도의 환경챕터를구성하는 것이 유리하다. 둘째로 환경영향평가 제도의 도입을 관철시킬 필요가 있다. 경제정 책과 환경정책은 밀접한 관련을 갖고 있고, 환경영향평가제도는 개별 국가별로 너무도 다양 한 형태로 시행되고 있어, 이를 조화롭게 통일된 형태로 적용할 필요가 있다. 셋째로 환경협 상 시 절차적 투명성과 공정성을 담보하는 절차적 규정 도입을 관철시킬 필요가 있다. 이를 위해 TPP 환경챕터에서 다루고 있는 여러 가지 절차적 투명성과 공정성 제고를 위한 제도적 장치가 RCEP 등에도 도입되어야 한다

영어초록

TPP agreement consists of a total of 30 chapters, this chapter of the environment is part of the Chapter 20. TPP oriented the most advanced norms a we can find easily that provisions embodied in the existing FTA are more concrete or improved, and one step further provisions are added Among the TPP chapters, environment chapter can be called such examples. TPP environment chapter contains a high level of environmental protection information, and at the same time new environmental issues such as Protection of the Marine Environment from ship pollution, Invasive Alien Species control, wildlife illicit trafficking, illegal logging, illegal fishing protection and marine environment protection, protection of the ozone layer and Transition to a Low Emissions and Resilient Economy change. South Korea, which has a high level of environmental chapter of the FTA, should lead the negotiation with the insertion of obligatory regulations to be enforced and the export of green technologies. For this purpose, the work of deriving policy implications and appropriate response measures by comparing and analyzing the contents of the environmental chapter in the TPP to the contents of the existing FTA environmental agreements is very meaningful. Especially, comparing and analyzing the KORUS with the highest level of environmental chapter to the South Korea – China FTA with a somewhat negative environment chapter from the perspective of developing countries will be a great help in successful environment-related negotiations After the comparative analysis of the three provisions, the policy implications and response measures to constitute favorable environmental chapter to South Korea are as follows. First, Partners should choose whether environmental provisions regulate in a separate chapter (chapter) or in the declaration form on preamble or in a chapter of cooperation. and in our view it is advantageous to configure a separate environmental chapter for a high level of environmental standards and green environmental technology exports. Secondly, it is necessary to stick to the introduction of the Environmental Impact Assessment. Economic policy and environmental policy has a close connection, and there is Environmental Impact Assessment conducted in so many forms for each individual country, so it is necessary to apply it to a unified harmony form. Third, during negotiations it is necessary to stick to introducing procedural provisions to ensure the procedural transparency and fairness. For this purpose, the institutional mechanisms for improving the various procedural transparency and fairness dealing with the environment chapter in the TPP should be introduced even RCEP back.
