초록

2003년 연방대법원은 Lawrence v. Texas 판결을 통해서 sodomy 행위를 규제하는 텍사스 주법을 위헌으로 선언하였다. 이는 유사한 조지아주 소도미금지법에 대해서 동성애 행위를 할 권리는 헌법상 보호되는 기본적 권리가 아니라는 점을 들어 합헌으로 판단했던 Bowers v. Hardwick 판결을 폐기한 것이다. 로렌스 판결이 이처럼 1986년 결정된 Bowers 판결을 폐기함에 따라 동성애자의 내밀한 사적 성행위에 대하여 헌법상 보호가 가능해졌다.
이에 본 논문은 먼저 동성애자의 권리를 위한 새로운 전기를 가져온 로렌스 판결의 구체적인 내용과 판결을 분석함으로써 그 헌법적 의미를 살펴보고자 한다. 특히 로렌스 판결에서 합의한 성인간의 사적인 성행위를 할 자유가 기본적 권리로 인정될 수 있는지 여부와 적용된 심사기준은 무엇인지에 대한 문제를 중심으로 검토한다. 다음으로 로렌스 판결이 동성애자의 권리의 다른 측면, 즉 혼인, 입양 및 후견, 군복무 문제 등에 미친 실질적인 영향을 살펴보고자 한다.
첫째 혼인문제와 관련해서 로렌스 판결이후 동성혼에 대한 법원의 태도변화를 검토하며, 동성혼을 합법화한 주(state)가 늘어나는 미국의 최근 상황을 살펴본다.
둘째 동성애자의 입양이나 후견문제와 관련해서 로렌스 판결 이후 관련된 판례를 검토한다. 다만, 입양과 후견의 문제는 동의한 성인뿐만 아니라 미성년자가 관계되어 있는 점에서 로렌스 판결이 적극적인 영향을 미치기 어려운 점이 있다.
셋째, 동성애자의 군복무 문제, 특히 1993년 채택된 Don't Ask, Don't Tell: DADT 정책의 위헌성 여부의 문제를 로렌스 판결 전후의 판례에서 나타나는 변화와 적용된 심사기준을 중심으로 살펴본다. 이를 통해 2011년 9월 도입된지 18년 만에 동 정책이 폐지되는 과정에서 로렌스 판결이 미친 실질적 영향을 검토해 본다.
결론적으로 로렌스 판결은 동성애자의 성적 행위를 규제하는 법을 위헌으로 판단함으로써 동의한 동성애행위에 대해서 헌법상의 보호를 제공한 매우 중요한 판결이다. 또한 다수의 도덕적 견해가 개인의 성적 삶을 통제할 수 없도록 할 수 있는 가능성을 제공해 주었다. 이는 동성애자들이 혼인이나 군복무 등 다른 영역으로 권리를 확대해 나감에 있어서 그 중요한 전기를 마련하였다고 하겠다.

영어초록

In 2003, the Supreme Court hand down its important decision invalidating a Texas anti-sodomy law in Lawrence v. Texas. In Lawrence, the Court overruled the Bowers v. Hardwick that the Georgia's Sodomy Law does not violate the Constitution because the right of homosexuals to engage in sodomy is not a fundamental right protected by the Constitution. As the Lawrence overruled the Bowers of 1986, the private sexual acts of homosexuals could be protected by the Constitution.
This study analyzed the specific details of the Lawrence, which rewrote the history of the homosexual rights to discuss its constitutional meaning. This study particularly focuses on whether the freedom to engage in sodomy between agreed adults can be acknowledged as a fundamental right and the standard of judicial review applied to the Lawrence.
Next, the actual influence of the Lawrence on the other aspects of the rights of homosexuals, including marriage, adoption/ child custody, and military service, was discussed.
First, the Court's attitude toward same-sex marriage after the Lawrence was examined in relation to marriage along with the current situation in the U.S. where more states allow same-sex marriage by law.
Second, related cases after the Lawrence were examined in relation to homosexuals' adoption and child custody issues. However, the Lawrence cannot have direct impact on adoption and child custody issues as they involve minors in addition to agreed adults.
Third, homosexuals' military service issue, especially the constitutional violation of Don't Ask, Don't Tell: DADT policy adopted in 1993, was examined in relation to the standard of judicial review applied before and after the Lawrence. Also, it was discussed how DADT policy, which will be completely abolished in 18 years in September 2011, influenced homosexuals' military service and whether sexual-orientation is an important element in military service.
In conclusion, the Lawrence is a landmark decision that provided constitutional protection for homosexuals by judging that the law that restricts the private sexual acts of homosexuals is against the Constitution. It also made it possible that the ethical view of the majority cannot control an individual's sexual life. The Lawrence has become a meaningful start point for homosexuals to seek other rights and contributed to changing the social awareness to respect their rights as minorities.
